I’m not missing anything. Since the emergency order was issued there’s been nothing but yapping about how non domiciled are all going to be revoked.
It’s not hard to miss all the crazy threads and misinformation being thrown around. How there’s going to be 200,000 to millions revoked etc.. Posts that claim Duffy has the power to revoke all non domiciled cdls..he absolutely doesn’t have the authority/power to do that.
He doesn’t have power over immigration law and his emergency orders were his legal limits. Hence the “emergency” part. In the end nothing changes except for new regulations on how non domiciled cdls are issued. Congress is mandated to give out 65,000+/- visas per year with an additional 65,000 this year. Corporate America relies on this cheap labor and the current administration is pro corporate America so if you think they’re going to appease some lowly truck drivers think again.
It is estimated that there are about 200,000 non domiciled cdls issued with a possible 20,000 currently non compliant ones. These are the ones that were issued by many states not just California. The remaining ones will be simultaneously revoked and reissued when the new regulations are set in stone.
Meanwhile the economy contracts negating any drop in freight capacity and leading to even lower rates.
The constant attacks on California are laughable because Duffy has proven himself as a lying hack. All the while Florida gets emitted from any list of offending states..They admit SD, TX etc are offenders but not Florida..any guesses why?
All for now, treated myself to a Starbucks coffee this morning at the TA in Brunswick, GA.
Side note.. I’m back in for another year..was able to secure cheaper insurance at the last minute
Constant Learner and Siinman Thank this. -
As the U.S. Secretary of Transportation, Sean Duffy did not need congressional approval to make recent changes to non-domiciled Commercial Driver's License (CDL) rules
. He enacted the new restrictions through an emergency interim final rule issued by the Federal Motor Carrier Safety Administration (FMCSA), which is part of the Department of Transportation (DOT).
Here is a breakdown of the authority used for the rule change:
- Administrative action: The emergency rule was implemented as an administrative action by the FMCSA under the authority of the DOT.
- National emergency declaration: Citing safety concerns and irregularities in how states were issuing these licenses, Duffy declared the situation a "national emergency," which allowed for the issuance of an interim final rule that takes immediate effect.
- Bypassing Congress: The use of an interim final rule bypasses the typical formal rulemaking process that can take months or years. While a public comment period was opened, the new rules took effect immediately.
Congressional involvement
Although congressional approval was not needed for the recent rule change, some members of Congress have supported Duffy's move and have introduced legislation to make the restrictions permanent.
- "Non-Domiciled CDL Integrity Act": The bill H.R. 5688, introduced by Representative David Rouzer, aims to permanently codify the restrictions enacted by the DOT.
- Enforcing federal law: The DOT's action is part of a larger enforcement effort to ensure that states follow existing federal regulations for issuing non-domiciled CDLs.
Siinman Thanks this. -
And that’s the reason why it’s going to take at least 2 years for any new regulations to become permanent..if they do.
An emergency order isn’t permanent..hence the two year grace period for compliant non domiciled cdls.Siinman Thanks this. -
That is good news man. Glad you got another chance to stay in the game.Concorde Thanks this.

Lol, I got no other choice, I still got truck payments!Siinman Thanks this.

Get rid of of all non domiciled cdl’s and only U.S. citizens who can read/comprehend and speak coherent english be allowed to have cdl’s..anyone who doesn’t fit under that..oh well..bye…enough is enough…
-
How much did they end up charging you and who did you go with this time? I am waiting on my renewal now to see what it will be next year. Should be same or a little cheaper I hope. No accidents or anything else, so I should be good for another year.
-
I think you miss a point, the states are not complying with the regulations, he has the power to revoke all of those cdls and audit all of the records to determine if the driver is qualified.
having a valid immigration status but not able to speak English makes the cdl invalid.
having an invalid immigration status makes the cdl invalid.
not proving you actually held an equivalent license in your home country makes the cdl invalid.
California among other states refuse to abide by the regulations they agreed to follow, this also invalidated all cdls issued by the state within the period of refusing to comply with them.
Duffy has the power to fix this problem, he does not need congress to act because they already acted by putting the enforcement of the regulations in his hands to make sure they are enforced without intervention of congress. This delegation of powers within the executive branch has been long established and as I pointed out, he has the power to shut down airlines, he has the power to shut down a state or revoke the licensing of those for interstate commerce. -
Berkely Casualty Co. Ended up around $26k..don’t remember the exact amount but a few hundred less than what Geico charged last year. May just be due to me lowering my valuation on the truck and trailer.
Geico $63k
Progressive $41k
And a bunch of others that declined me
Just hoping I don’t get in any bad accidents or some You boob wannabe investigator will call me out for “insurance hopping”
