The bidding is supposed to go up, not down. You're a driver, not a broker!

So a little update that I imagine with rankle some: In 2014 I went on a bit of a crusade and reported a scuzzy ~100-truck company to the IRS for 1099ing its company drivers. There was nothing "independent" about it - the company provided the trucks, dictated schedule, loads, routes, etc - and was dumb enough to say just that on their Craigslist ads. But they were still managing to fill seats paying 39cpm (1099) when everyone else was paying 38cpm (W2) as a constant churn of drivers rolled through not realizing they were being screwed until tax time.

Not that my motives were pure as the driven snow -- this company kept under cutting me on loads going home (which isn't hard to do when you illegally cut your largest expense 15+%).

Anyway, the IRS sent a form letter reply acknowledging they had received my complaint, but I then heard nothing for ~4 years.

Until today, when this came in the mail:

The IRS goes on to say it determined the company underpaid its taxes by ~$370,000 which was pretty close to what I'd estimated based on 7.65% FICA, the 13 million miles they reported to the fmcsa, and $0.39/mile. They easily underpaid at least as much by not paying worker's comp, UI, etc.

Anyway, the preliminary award is ~$52k, but it isn't scheduled to be paid until October -- of 2019... The IRS will, of course, withhold 15% and I wouldn't be surprised if the actual award ends up being lower.

But, if you're ever feeling vindictive at the end of a long day, there are probably worse ways to spend your time than perusing:

    Good for you.

Frankly, I don't know how a lot of these lease op companies continue to get away with it. So many of them are skating a very thin line.

####, I know of a bunch of local 1099 companies that beat me on price all day long. I could make a living ratting them out!
