DRIVERS THAT ARE NOT REGISTERED BUT DRIVE TRUCK AND CARGO THAT IS REGISTERED

    Hello everyone,

    I have a company and it is going through some changes, I have insurance for one of the driver that covers liability and cargo and property damage, however, the same insurance does not cover another driver because he has a bad record. His truck is covered and his cargo is covered but he is not covered. Can anyone tell me what would be some of the repercussions if he were to (1) get pulled over? (2) get into an accident? and if there are any repercussions against the company?

    If your insurance does not approve the driver then that driver had better not be caught driving your truck. If he is inspected and even if he has a valid cdl and the insurance finds that inspection report? They are likely going to drop coverage for everything- and fast. If he has a wreck your liability is good for nothing. You will be toast.

    Exactly right. If the driver isn't covered on the insurance the OP needs to get him out of the truck. Now.

    Maybe, maybe not......if the driver is excluded by endorsement, (in a state that allows driver exclusions and the policy is NOT a Named Driver policy) then yes insurance can & will decline most losses. If driver is not excluded by endorsement, and your broker got you coverage in a decent trucking oriented insurance carrier, and your coverage includes Hired & Non-Owned you may get lucky.

    Make sure whoever your insurance broker is, that they know & understand trucking, and listen to their coverage recommendations.....even though it will cost more in the short term it may well save you in the long term....especially if you have any corporate assets to protect.

    "Repercussions"? You'll no longer have a company if he causes an accident and the injured party sues you. Do be stupid and let him drive uninsured.

    When it comes to insurance coverage and the potential for liability I wouldn't want to trust luck.
    You're either covered or you're not and insurance companies will always act in their own best interests.
    We just changed insurance carriers and before we accepted the coverage we had our attorney look at the policy. He had a couple of suggestions, the insurance company revised a couple of clauses, and now we know exactly where we stand.
    We decided not to trust our luck.

    Exactly why I said consult with one of our industry professionals who do truck insurance enough to understand the market, and to understand the correct coverage's to protect you and your assets.

    Insurance company Branch Manager, heavily involved in trucking for hire.......owner ops, up to and including 200 power unit fleets.

    We see the gamut, from friendly Juan the Retailer insurance broker in the San Joaquin, trying to find coverage for a relative who has a new CDL & new authority.......up to Aon/Marsh type of accounts with good risk management techniques and a professional insurance person involved.

    While Juan may end up with coverage for his relative it will in all likelihood only meet the minimum required to get him legal......not what is really needed to afford him the proper coverage to really protect his assets, where as a true insurance professional will provide a quality carrier, at a reasonable price that affords the best coverage possible.

    Thanks for the clarification. Basically you're a shill and an apologist for the insurance cartel. That's okay, everybody should do what they do best.;)
    Everybody in trucking knows that insurance is a necessary evil. In a litigious society insurance is a necessity.
    Just don't start preaching that the insurance companies are our friend and that they have our best interests at heart, okay?
    Most of us know better than that.
