    BTW, Subchater B includes part 395, which is the logging regs, which includes ELD's

    § 390.3 General applicability.
    (a) The rules in subchapter B of this chapter are applicable to all employers, employees, and commercial motor vehicles that transport property or passengers in interstate commerce.

    § 390.5 Definitions.
    Commercial motor vehicle means any self-propelled or towed motor vehicle used on a highway in interstate commerce to transport passengers or property when the vehicle -
    (1) Has a gross vehicle weight rating or gross combination weight rating, or gross vehicle weight or gross combination weight, of 4,536 kg (10,001 pounds) or more, whichever is greater; or

    Again, just because it's not yet plated doesn't mean it's not a CMV. And since it's a CMV and it's being moved at the direction of the motor carrier it falls under the same ELD rules as everyone else.

    It’s not a CMV, it’s not in commercial service, can’t be under a DOT#’s direction with no plate. The ELD reg is Federal and they don’t have jurisdiction until the truck is in Interstate Commerce. Their regs mean #### until you’re being PAID to haul something across state lines. You can give them the finger on almost all of it if you can prove you’re doing the move for “no compensation”. ICC and most Fed DOT regs mean nothing as soon as you write “not for hire” on the side of it. If you’re not being paid it’s not a commercial vehicle period, no matter how big it is.

    Except the moving the truck itself makes it commercial across state lines.
    So for reference you've changed your reason three times now and still no regulation pointed to to prove what you are saying.
    I think I've provided enough to show it is a CMV and subject to ELD until shown in the regulations otherwise. Just because you don't want it to be, doesn't mean it's not.

    P.S. Not for Hire just shows your ignorance in the regulations as it has absolutely no meaning in the regulations.

    You should pick up a dictionary first, and sort some definitions out. Then pick up a book of regulations that apply. In the meantime maybe giving advice on compliance is something you should avoid.

    Do you speak English as a second language or something? Post all the regs you want out of your little book there Perry Mason. They don’t apply

    guess what it's not a CMV until it's registered as one...
    NOT ENGAGED in "interstate commerce"
    NOT "transporting passengers"
    NOT "transporting property"

    So ya NOT A CMV

    It is, simply moving it across state lines makes it interstate commerce.
