I have a commercial class C with haz-mat. The truck I drive now does not have air brakes. When that truck brakes down we get a rental from Penske. The rental truck is still a 26 gvwr but it has air brakes. Am I driving out of class when I drive it?

I'm in California and it does say my restriction is air brakes on my license.
-
Yeah you need to be tested with air brakes at DMV before you can drive vehicle with air brakes. (legally)
-
However it is under 26k so that is a non-cdl truck to begin with, right? -
Yup you are out of class and it is a misdemeanor

They take your child away, they take your house away, they take your dog away, but they MAKE YOU keep your wife!
DEAR GOD MAN, get legal!
It may be only a written test that you need to pass, inquire at your local DMV for more information. And if you do need to take a skills test, tell your boss, let him decide if it is all worth the trouble. And if it is? Then he should flip the bill for the tests AND truck you will need, as well as a sponsor going with you to the test site, if a road test is needed.
GOD, KEEP YOUR WIFE?
GIT IT DONE MAN! -

Should be only a written test and some $$$ to get rid of that restriction. Better to do it and CYA.
