Driving with a permit

    A buddy of mine is going to take his cdl permit test here in a few mins, he was wondering if driving with a permit will effect the time of the driver he will be running with, hes heard both yes and no, so we figured wed come here and find out for sure, weve looked on the internet and didnt find anything about it, if it does effect the drivers time, how much of the time can the permit holder drive the rig according to law?,,,,Thanks Mark

    OK, my friend, here's the deal. Your buddy with his permit has to abide by the HOS rules, and his "trainer" needs to be in the jump seat while your buddy is behind the wheel.

    Whoops, forgot, the trainer has to log "on duty" while training the student with the permit. Your buddy can drive/work 70 hours.

    a CDL permit holder comes under ALL the rules of truck driving. so say for instance (from what i gather you are asking) your buddy goes on a trip with a licensed CDL driver.....can your buddy drive as well...?? YES, but he MUST fill out a logbook if he goes beyond the 100 mile air radius, or if local, works more than 12 hours.....

    as a CDL driver, (even permit holder) he can drive the legal 11 hours, although i highly suspect he won't make it past 3 hours till he tires out.

    oh, he can even leave the state he has his permit in, and drive mind you cross state lines, as long as he's with another licensed CDL driver..

    Funny story for you.....

    We were crossing into NM on I25. Raton pass....you ALL know that POE right? You've probably been into it a few times, they're jerks! (no offense to them, but they are!) We get to the scale, "trainer" pulls up, HP walks out of the office....

    "I want your log book, truck book, trailer registration, BOL, and all your other papers."

    Oh crap we're thinking, hopefully we're legit right? (we were by the way or so we thought)

    Trainers log book carbon was thrashed so it didn't transfer. He's standing there with the originals in his hand, HP wasn't hearing it. Long story short, he ends up with a 10 hour forced break. (4 hours into our drive) Don't lecture me on the HOS and logbook being the drivers responsibility....I was lecturing HIM!

    Thing that got me was that the Highway patrol guy had NO clue how permits work.....he thought we could continue our drive with me driving instead of him! We both looked him dead in the face and said NO. He had the Port guys call our home state and verify, he didn't believe us! It was hilarious, absolutely hilarious! I thought these guys knew their jobs, knew the rules....apparently CMV's are not in NMHP's handbook. IT was even funnier when we finally pulled out at 2am when we went in to clear with the port guy........he was laughing his butt off about it too!:biggrin_2559:

    Basically the Licensed driver must log line 4 when in the passenger seat. Does count as on duty, but not driving.

    I feel bad not answering the question, I wanted to share the story though....yes, he can drive, even across state lines. (not sure about canada or mexico) AS LONG AS HE FOLLOWS THE RULES. HOS does count when you're a permit driver. I agree though, first couple trips I couldn't drive 11 hours.....its very stressful at first. Now I have no problem with it. If I could just get the backing down I'd be set!

    well everything sure did answer my question, its helped out alot, Thank you folks for the advice on the matter,,,,By the way he only passed 2 of the 3 tests, he has to go back next tuesday to retake the air brake portion of the test,,,,Thank you all again,,,,Mark

    failed air brake my first time as well....however, here in CA, I was allowed to re take the test right there....after I studied the corrected failures!!!

    Another story......this is CO. I stood there and took my tests for my permit. Aced it, lady said I didn't miss one, I was proud of me. Guy beside me failed all 3, not once, not twice......3, yes THREE times. They'll let you retry it 3 times! Lady said they get the test anxiety thing in there alot, this guy had it. I kinda felt bad for him, at least here they don't charge you for failing the written tests.
