this is wrong, an owner who already has a jacket (employment file) doesn't need to have a pre-employement test, that's only for new hires. Returning to a driving position, they will have to be put on the list for a random and that's it.
I got this from both the fmcsa and my legal advisors when I retired from driving, if I return, because my driving is no longer needed but my employment continues, I am not a new hire.

As @Ridgeline stated, you would then have to enroll yourself back into the random pool in order to be eligible to drive again.
The point that I'm making is that just because you own the company and you have a CDL, the rules do not state that you absolutely have to be part of a Consortium, as long as you do not drive at all, ever. -
