Drug testing, for the O/O taking a break from the business.

    this is wrong, an owner who already has a jacket (employment file) doesn't need to have a pre-employement test, that's only for new hires. Returning to a driving position, they will have to be put on the list for a random and that's it.

    I got this from both the fmcsa and my legal advisors when I retired from driving, if I return, because my driving is no longer needed but my employment continues, I am not a new hire.

    Thank you for posting the regulation.

    I think that what I said is accurate. If you have a driver and under no circumstances will you drive, regardless of emergency, driver is out sick, truck is abandoned, etcetera, you plain do not drive ever under any circumstances, you are not required to be tested. UNLESS you want to be able to drive on occasion or for emergencies. Then that is a different story.

    As @Ridgeline stated, you would then have to enroll yourself back into the random pool in order to be eligible to drive again.

    The point that I'm making is that just because you own the company and you have a CDL, the rules do not state that you absolutely have to be part of a Consortium, as long as you do not drive at all, ever.

    Well I would ask at your next audit. I just got audited and I didn't ask... so it might be a good idea to ask and be sure. Get it in writing.

    That must be why Schneider pulls a drivers driver status once they go into management. So they can attend all those lifestyles of the rich and shameless type events.
