I’ve got something to share that I haven’t seen talked about—my company that I work for (about 2yrs now) has never drug tested me. Even for pre employment. They are very lax, are not a trucking company but a company that has trucks (so they are not privy to DOT requirements) Could this ever be a problem for me?

    What kind of trucks?
    Do they have a DOT # ?
Do you have a CDL and have your own personal clearinghouse account?

    tscottme Thanks this.

Then you personally can be subject to fines not just your employer.

“The DOT requires all CDL drivers to participate in a drug and alcohol testing program, regardless of whether their employer participates in the DOT program.”

If your employer gets audited, I hope that they have deep pockets :)

Are they a new Clown company or just ignorant?

    darndiggity Thanks this.

As the Drug testing program is your company's responsibility to maintain according the the regs, you shouldn't have a problem. But you company will be in a world of hurt if the FMCSA were to do an audit or have any reason to check. @brian991219 might be better able to answer this.

tscottme, Grumppy and brian991219 Thank this.

Holy smokes thanks for this info. They’re actually a legit small local family company that pulls good business and takes good care of the trucks, but they skirt by regulations like OSHA and god knows what and probably have been doing so since the companies conception.

Look, depending on what your company does it’s quite possible they have a waiver. You didn’t give a whole lot of details.

Anyway I would try talking to whoever is in charge about it. If they blow it off then I gave a link to the fmcsa where you can file a complaint.

During roadside inspections now the officer will/should be checking the clearinghouse. What they actually look at and see who knows.

How long have they been in business.. New entrant audits can take up to a year, mine was done within 6 months.
