Dui and off duty

    Army91w (what is that anyway, get a real job). 91w is correct and chicken man is wrong. It's all about the dead presidents. I personnaly no a guy got dwi spent $9500 got it turned into reckless driving, was fined and had to go to drunk school. Did lose his license for appx 3 months while going thru court. I no another guy got a dwi didnt have the funds couldnt even get a public defender. He lost his ###.

    He will not lose his CDL for good off of a first time DUI in a personal vehicle. Thats not the way it works. Will have a tough time finding a driving job for a good while, but he will not lose the CDL for good.
     
  4. Funny thing happened when I got into work this morning............Got called in for a random drug test. Just returned to work Monday after my seasonal 11 week layoff. Letter was dated yesterday, the day after I returned..............is it really random or ? Good thing I'm a good boy!!

    I believe thats a DOT thing. If you are off duty for 30 days or more you have to take a drug test before you can legally drive a big truck again. I found that out last summer after being off for 6 weeks. I was literally sitting in my truck ready to back out of my driveway. My company called me and told me DOT requires a drug test cuz I was off for more than 30 days. Shut my truck off and drove my car to the test clinic......3 or 4 days later I was back on the road.

    Same here. I never drink while on the road, not even during a restart. I do drink at home, but you have to be careful. I knew a guy that was over 200 lbs, drank one 22 oz beer, and nearly went over on a breathalyzer. That means drinking 2 12oz beers would have put him over for sure. Like it or not, drinking laws are so strict that it is essentially against the law to drink anymore. Forget having a few beers while bowling or going to a bar or watching a sporting event. I am sometimes tempted to move to another country that has more common sense and freedom.

    Bell v Burson was not a case of DUI and suspending/revoking a license. It was a case of insurance and liability disposition. Secondly, the court and the State remarked that a license was an "entitlement"! Nothing about "privilege"!

    You sub titled your post as "get your facts straight"....yes, why don't you have your facts straight?

    Your argument; " I had to go to school for my license and I also paid for them, wasn't nothing giving to me", is moot in regard to "privilege" or "rights". Just like comparing a drivers license to a hunting license....which you have to pay for and in most states you have to "go to school" for, and owning a firearm. You have the right as a citizen (excluding felons) to own/posses the firearm, by completing the requirements of Law, you thereby gain the privilege of hunting legally.

    Also you are wrong about the laws being so strict about "drinking and driving".....nowhere in the Law does it state that you must drive after you drink (alcohol). You have the ability to hire someone to drive you wherever you want to go after consumption of alcohol. Ever heard of a Taxi, or bus, or calling a sober friend?
