It is that statement in the fmcsr that gives the driver the right to file a complaint with the state dot where that company is based at. If you didn't make the change or notated the note then it is a violation to the one who did. It also helps to have proof. If it is qualcomm then you can go online and print out the change they made. Mark it and send that to dot with your complaint. When dot looks at it if they find that what you say might be true they will go in and do a company audit. But if you already got a fine from dot for it then filing a complaint now might not float.

Also on that note. The company can make changes to your logs only if they have your approval with what exactly needs to be changed/corrected and to what. After that they have to print it out and you sign it for record the next time you are at the terminal. With out you asking them to make the changes they are not allowed to touch your logs.

From what i've heard, most drivers that have complaied to fmsca about their companies experienced little or no help from that POS agency.

Yes the FMCC is just a joke.. They say there is nothing they can do about it.. Because I didn't cross any state line.. I guess we as drivers should tell the dot they don't need to see our dot cards because we didn't cross and state line for them to check to see if it is up to date then. If we are in the stste of the company we drive for. Or tell them we don't have to fill out the log if we are in the state of that company..

First, you broke the law. Sure, they did, too. But, all you had to do was tell them "I'm out of hours, sorry, can't do it." And then go park somewhere, go home, what have you.
They can't fire you for that. Just make it real clear, in writing, either by email or qualcomm (something traceable), that you are not violating HOS for them. And the second they updated your logs, I'd have sent one nasty AND LONG qualcomm to them explaining that they are in violation of HOS and you will NOT be complicate in their actions.
If they fire you, great. You will do more for you, and trucking, in the ensuing time than what you're doing now. A company still running, and you without a job or income.
As for big companies, many times the left hand doesn't know what the right is doing. So, the five skids is just a big miscommunication between two parts of the company to not relay the needed info (that the load was pulled). But the fact they'd so brazenly edit your Line 3 to accommodate the pick up just reeks of trouble for them. And I'm guessing this wasn't the first time this has happened.
This is one of the reasons why I am against EOBRs and the company 'holding' your logs. You don't have any paperwork to back up anything you said.
I drove for CR England and they went to EOBRs during that time and was always uneasy not having direct access to what I'm 'signing for' at the end of the day. My friend ran into an issue when the Qualcomm experienced problems. He was driving through Montana and was pulled in for an inspection. He had them fax a copy of his logs to the scale. Now, to CRE, his logs had been fine and not triggered any violations. However, the statuses were all screwed up. In fact, it had shown he was in SB (Line 2) the whole time he was DRIVING that day. Now, the officer agreed that with EOBR that was impossible and obviously a mistake. However, he still received a violation on his inspection for Status not current.
Something with the relaying for CRE from the Qualcomm on the truck to their headquarters worked fine until it was stored was corrupted. Yet, the logs department, who store copies for finding violations showed him in full compliance for the whole week. His qualcomm screen showed his logs to match with what the CR England logs department showed. However, the faxed copy (i.e., the official copy) was corrupted.
And the driver gets the ding on his CSA for it. -
"I just started with ECM Transport last week.....So far not too bad other then an attitude from my distpatcher twice this week....on Monday the today(friday)......One more and I'm done....I quit a job I had for 5yrs because of crap like that/this...No biggie here to do it ASAP.....Plus they try'd to not pay me what I was told I was gonna get an hour but they fixed it yesterday...I hope,LoL......I really don't think I'll be with them for along time but then again who knows....If the attitude keeps I won't be and I don't give two weeks notice so I'm sure they will be lovin that,lol....And what he(the person who started the tread) said is true about how they do logs....But I can tell ya I won't be doing that at all for them.....That Is A Def 'NO' from me......And this is the first time I have ever....EVER worked for anyone who doesn't pay O/T....But the pay added together over the job I passed up(and was told I could still have if I wanted)was a bit more....So....I can say I'll try and stay awhile atleast but I will NOT be letting them tell me to do anything illegal cause I know I'll be the one getting f**ed in the long run not them.....I would have let them fire me too and sued!!!!! I'll bet Pitt/Ohio wouldn't be liking that,LoL!!!!!"

As Of today....(8/25/12) no fix on my pay and I do have proof of what I am supposta be paid....Looks like it might be lawyer time.....
