    The feds do have certain things which must be included in every lease agreement between a carrier and an owner operator.

    There is always a choice. If the EOBR's become mandatory and you don't want to use them, then you could get your own authority or do something else. There is always a choice. You could also write those in charge at the FMCSA and your elected representatives. Explain to them how having to run under the EOBR will negatively impact you and your health. One reason some of these laws get passed is because truckers don't take the time to get involved and make your opinions heard by those who can make a difference. It is usually a small group of very vocal people who get these laws enacted. If only 10% of the truckers would take time to contact their representatives it would make a huge difference. We do a lot complaining amongst ourselves. If we did just a little of the same to our representatives, it would do much more to turn this industry around.

    There is currently a Request For Comments from FMCSA regarding EOBR's that I have posted a link to but as of this posting only 60 comments have been received .     I didn't have a problem. There are now 61 comments. According to what I read, it may take several weeks before comments are visible to the public. That seems odd. Perhaps the government is deleting comments which are not favorable to them. Comments should be visible immediately after posting. If you don't like or want the EOBR's you need to make your voice heard.

    Well, I for one have had enough of the BS. I'm not going to have the government tell me what equipment I have to buy and that I have to take two periods of rest between 1am and 5 am to reset my 70 and that I have to have a 30 minute break after 8 hours of work and on and on. I'm selling my truck and trailer tomorrow morning, suspending my authority, and moving on to a home every day office job again.

    I dread the thought of being a Monday through Friday office dweller again but the current environment for small business truckers is just getting too much for me to justify continuing. I believe the EOBR law will be implemented and the main reason for my belief is that money drives the legislative process in this country and the big carriers/ATA want it. If safety was really the goal of the FMCSA they would have implemented a law holding shippers and receivers liable for any time over two hours loading and unloading along with this EOBR rule. Along with that there are a hundred other things I could rant about along the lines of safety and the "new" laws but there is no point.
    I hope for the sake of the rest of you independents that things aren't as bad as I see them. I've actually done well this year but the opportunity to close up shop and liquidate has presented itself and I'm not going to chance it. Being safe and strictly following the new laws are not one and the same. Good luck and stay safe if not 100% "legal"!

    they don't want detention time messed with,

    They lobbied for and got the new HOS and EOBR...

    And now they are claiming all these new regs are going to wipe out the independents and O/O that are so important to the industry...
