Employer wants private medical information from routine Dr visit

    yes, I HAVE had a company request this, BEFORE i returned to work after a work related injury.

    the company wanted to make sure i was clear for work, with NO restrictions.

    but i was never threatened like you claim you were.

    what threats did the company make towards you..???

    they have every right to know if you will be on meds, and your work status.

    sometimes, even an injury OFF company property, the company NEEDS TO KNOW, if you're going to be on pain meds, etc.

    you really left out a whole lot of information.

    It’s not adding up. Getting a note that releases you to work without restriction says to me you didn’t go in for a tummy ache. If you needed documentation why didn’t he just write that he saw you on that date and what time if you were worried about proving to them why you were late. The way it’s worded it sounds like there’s more going on, or they’re concerned what you may have been prescribed.

    What more information do you want me to give you? As far as threats go, I never said they made a threat. All they said is they will not release me to drive until I release my reasons for the doctor's visit. They want to know the nature of the visit and if there was any medications prescribed. There was no medication prescribed, and it was nothing related to my job. Now is it was like a major surgery then I can understand them wanting a little more information. But as far as the nature of the visit that is personal. I even have my patient advocate trying to contact them at the moment

    I document everything... I have pay stubs from when I started working back in 2006 still. I have every bill that I have ever paid and bank statements dating back to 2003. I have every piece of paper that I have ever been given in the army also filed. I cover my ### on all ends. I'm not sure why you guys find this suspicious. But hey I guess personal preference. I don't exactly need your approval I was just simply asking if any other fellow drivers have came across issues like this. But yes lesson learned next time I have a doctor's appointment or anyting regarding me taking a day off for any reason I'll just simply note in the reason for request personal. As far as I'm concerned they have until tomorrow morning to release me back to work or they will be charged $500 a day for the safe gaurding and storage of their equipment. Jobs are easy LOL

    Incorrect. Your medical history is non of their concern. They do not have a right to know. They are NOT medical professionals. If you have a heart transplant, its non of thieir business. If your dr examines you & says you are released to go back to full duty with no restrictions, thats the final word, thats all they need to know. Again, they are not medical professionals.

    If this was a work related injury, workman's comp or the insurance company is all that needs any paperwork except a release. And if it was a work related injury, your company would already be aware of it & the circumstances. They dont need a copy of your medical records to know what was wrong.... only that you were treated by a physician & that you have been cleared by your physician to return to work duty status. Your dispatcher/supervisor etc is not a Dr & can not say if you are physical or mentally able to return to work. End of story.

    HHS is the government agency that regulates this. HIPAA is the name of the ruling/rule/law.

    Thank you, this is my exact point. I got some one from HR wanting medical information when they are not a medical professional. If they are this concerned then they need to send me to a DOT physician on their dime.

    Hipaa does not cover fmcsa regulated drivers, they are exempt.

    We'e talked about this RIdgeline, and you are still wrong.
    HIPPA does cover fmcsa regulated drivers. What it may not cover is the stuff related to a dot medical exam. This has nothing to do with that.
    Of course HIPPA doesn't apply anyway, but for the reason the person can specify anyone he wants to have the records.

    Because the op doesn't work for a good company. At least a good company in the regard.
    At my last company we needed a Dr. note if we took a sick day off. They treat adults like kids and wonder why they can only keep crappy drivers.
    And the one time I played their game the note was a return to work form as that's the canned response they had. Every other time I simply told them I didn't have one and to fire me if they didn't like it. Unfortunately they never did.
