While I am still not for blanket mandate that all commercial trucks be outfitted with EOBR's like the ATA and big carriers would like, there is a strong case for their use just as a CYA measure. Read this and see....

How would a eobr help any? Is it going to keep the truck from starting?
People look to goverenment for cures to problems that are caused by goverenment, the cure for these problems is to put more clorox in the gene pool.
The biggest problem I have with eobr's is it would violate the 5th ammendment of the USC. You being forced to give incriminating evidence agianst ones self is unconstitutional, if you were to be in violation. There will be the regular goverenment butt lickers that say; "it's in the regulations". Good, I don't care. Let me have the fredom of choice as to what I want to do as the founding fathers intended.
Reading the link you posted this guy would have probably had three diferent eobr's instead of logbooks anyway. He was stupid best I can tell. He should have destroyed all incriminating paperwork and looked stupid when being questioned. Does anyone remember the right to remain silent??DrtyDiesel Thanks this. -
First off, he got the jail time for KILLING SOMEONE that was entirely his false while running four log books, not just falsifying his current and only book.
That's the reason he got extra prison time. He also had bad brakes and was probably so quick to drive and log illegally that he wasn't inspecting them. And with the way he was driving, he probably was way overusing them to stop. And this time couldn't.
A guy shaving 15 minutes off because he sat in traffic yet all his receipts, transponder remarks, BOLS, etc all match his time aren't the cause of the problem that driver created.Raiderfanatic Thanks this. -
Most important thing he didn't remain silent.... With the society that looks to always blame something or someone for everything, if theres a dead body best thing to do is say nothing... This guy wasn't to smart running four logbooks, driving on bad brakes and then admitting all of the above.

Well criminals are not the smartest. I cant help but to notice the spelling af all the last names. Looks like a "good ol boy club" from the eastern block.
-
I was noticing the state myself theres been a recent increase of people from that region with problems.
-
I noticed that also. Sadly the whole story doesn't surprise me after seeing the names.

When they mandate EOBR's & they will eventually, someone will develop a hack. People that break the laws have always found ways around them. It will not prevent guys like this from driving this way. All a EOBR would have done in this case, is record what authorities had already discovered.

Just as we have laws for laws, this will never stop.
I am not for anything close to this being justified by clowns killing and maiming people, obviously no one cared even during the investigation since 99% of this would do nothing but make the family feel good.
I am all for getting the basket cases off the road, just no good way of doing it besides roadside justice. -
True, this idiot and others like him, an EOBR will not be any different. But for those of us that got into a pickle and would happen to run into that ambulance chasing lawyer that wanted to give your logs an anal exam, an EOBR would really cover your bacon. Remember, any paper log with so much as a minor mistake, can be construed in court to show you were trying to falsify. It isn't what a lawyer can prove or disprove, it is what he can make a jury believe.
