I also don't respond well to insults and putdowns. What I respond well too is FACTS, cold hard FACTS. So far I have seen NONE! Please show them to me!
-
Also if this is all your going to link to don't bother. It is just the entire HOS rules. I want the actual section that says YOU MUST CHANGE STATUS!
-
Scottie has given you the facts. I'm not going to repeat them because you refuse to believe they say what they say. Again there is no point arguing with you. You are one of those people that think if they just talk enough what they want the world to be will be. I'm just pointing out to other readers to not listen to you as you are simply unwilling to believe the law as written.
-
NO he has NOT. NO fact has been produced that says you must log a change of status when you exit a sleeper. Now Stop this obfuscating and insulting because I'm about to start insulting.
-
And I still maintain that logging is ON duty and you are logging a change
-
Post 38 dosn't say that? Wow, your ability to make crap up out of nowhere is astounding. Again, just because you don't want it to say that does not mean it does not say that...
And yes, I'll let you have the last word now as that is also part of your psyche you must have the last word.... -
I disagree with you. However your comments are not ignorant and visceral like some in here. They carry on like there are DOT cops hiding behind every tree with a pair of binoculars waiting to pounce. Very little common sense.

There is guidance that very short on duty work does not have to be logged. It has to do with answering a call from the office, but I think it would apply here too.
But you are right that following the text of the law it must be on-duty It's one of those times I don't think there could be a way to exempt that requirement without causing more problems, so FMCSA just ignores it by policy.
Would be neat to see a court case about it it. Not that I want any driver to have deal with it. -
You really want to hold to that statement? Really?
If this is the best you have you have nothing!
Oh BTW
395.8(f)(1) Entries to be current. Drivers shall keep their records of duty status current to the time shown for the last change of duty status.
Right there it tells you if you change your duty status by leaving the Sleeper to get out of the truck, that is a change and must be recorded in the Record of Duty status as a change. To do otherwise is falsification period.
Right here he is saying JUST that, He is saying you must change duty status to off duty when you exit the sleeper. (in this case the truck but the meaning is the same).Last edited: Apr 19, 2018
