If such is the case, they can change what they want, whenever and however they want, per the red line.

Not correct. They are just banking on you not taking them to court. Some blanket "terms and conditions can change at anytime" is not enforceable.

If you're out on your own, keep a corporate litigator on retainer (like $3-5k, and they bill against it if you need something). That way if something goes sideways, you have somebody you can call that is already under contract and will jump on it.

    NightWind and crayo360 Thank this.

Did they say why they will not honor the lien release that you sent them? Who did you correspond with at the factoring company?

I have had an attorney for 38+years and it has saved me more headaches than I want to think about by simply keeping me from getting into legal contracts that were NOT ethical not to mention keeping the random fake broken windshield people out of my insurance.

JolliRoger, Coffey and REO6205 Thank this.

I prefer you consult a lawyer to handle your situation legally.

2 months later and still no money. Ecapital finally responded and said they are entitled to keep my money since my authority is inactive. I told them I needed to use my money to secure insurance so I can reactivate my authority. They suggested I take out a loan and even then I’ll still have to factor with them or pay a $10,000 cancellation penalty.

Hard to imagine what contract terms you signed that would allow them to keep your pay.
To me it shouldn't matter if your authority is active or not., to receive payment from the factor company.
You need to hire a lawyer to review the contract and (if it's possible) send a letter requesting your money.

    Siinman and Coffey Thank this.
