Failed to use seat belt in CMV on DOT report

    Coded 392.16a on DOT report. No ticket issued. Is that a serious thing? I thought it was not a big deal but it says 7 csa points.
    How's that look if you apply for a job?

    It is now on your PSP report for 3 years, like any violation. Many drivers, like me, thought something like this was a harmless "warning ticket".

    For the next 364 days that violation will be weighted 21 (3 x 7). For the 365 days after that they will be weighted 14 (2 x 7). For the 365 days after that it will be weighted 7 (1 x 7). The day after that last day it will be weighted 0.

    It will be SOME hindrance in getting a job if the next company. I think seatbelt & cell phone violations are pretty big deals. I was only on the fun side of the steering wheel. Other regulars have lots of experience weighing these events. Don't overreact. But you cannot afford to Don't be super-extra careful. No company cares if the officer was fair, or if you agree with the entry, etc. You have a CDL & if you aren't almost perfect almost all of the time you pay the price. We all make mistakes.

    i looked it up and rhe phone in hand is 10 points. 7 points for no seat belt is a little harsh, like speeding over 11 mph. Can they disqualify CDL if you exceed a certain limit on that PSP report?
    The problem is that you cannot fight these violations on the inspection report as you would with a regular ticket.

    There are no points associated with your PSP, the points are for the carrier’s CSA.

    I was reading about all these unsafe driving violations and points assigned and I was astounded to find out that they consider not wearing a seat belt more severe than following too close or disobeying traffic control or using improper lane. Interesting to say the least.
    Oh well, wear those seat belts, the public safety depends on it.

    I don't know if your CDL can be revoked because of PSP. It is more likely someone with too many PSP violations would simply not find decent work. I hope the proper response to the violation would be to be triple--double-super-extra careful and not get one more PSP violation for anything over next 3 years. The worst outcome is to carry on in the same way as before the violation.

    I suspect, professionally, the safest outcome is stay put at current employer for 1-3 years so this issue is reduced in severity. Do you have other violations/entries on your PSP report?

    Having a CDL means you volunteer for strict enforcement. Learn from mistakes & move on. Nobody is required to like the rules. I lived through the seatbelt period before, during, & after they became mandatory. The habit of putting it on before you move is just as much a habit as not putting it on. It is what it is.

    No I don't. The last one was back in 2010.
    I am not employed per se, I am in a joint venture of sorts, meaning sometimes, when needed, I drive a truck.

    I don't intend to change it. Just suprised it got to be such a big deal; calling it unsafe driving and all. It is what it is.
