If I remember FMSCA correctly (and I could be wrong) legally if you are required to leave the premis, and you arrived during your available time, can't you move to the nearest safe haven/parking area to take the 10?

still a violation, and safe haven is for unexpected delays, weather, accidents, road conditions. This would pretty much be a trip planning issue. If you make a remark stating your situation you'll more than likely skate during an audit.

I just wanted to check, it happens (especially with the frozen load warehouses sometimes). Usually right outside the fence there is a place available for parking, but....

I guess I should have made a note that my sarcasm is at an EXTREMELY high level. Especially as I've run "cowboy" for many years accident free.

To me, "many years" means way more than 10.... to me, 10 is some "short years"..
Ask an old hand out there that has been driving since the 70's, accident free....see what that driver says.. I am still a rookie, and I will stay one until my peers say otherwise...mtnMoma Thanks this. -
You keep pointing at the driver and it's not. It's a team effort. You see it takes communication and planning on everyones part. Someone doesn't do their job the link is broken. Then the driver takes the heat or has to reschedule. Alot of the shippers will figure just drive time. 660 miles, yep he can deliver in 12 hours. Then you get stuck on the dock 3 hours. Then to top it off you get preplanned on a load that is already late picking up. Anyone that looks at the computer can tell that driver is out of hours. That stuff happens alot. Then you get em all pissed off telling them you can't do it. The whole time they twist words hoping you'll do it. To me, that's not working together. Each dept has their own little goal with no regards to the next.
It would be something you have to sit outside a gate until the next day because unloading is going to to put you over. But that's what an EOBR will do unless the customers gives. Them perishables have to be delivered. You don't have the luxury to sit on them.kajidono, SheepDog, quickway and 1 other person Thank this. -
