False log violation

    Hopefully insurance doesn’t take a hit. I know I’m not the only one to get a log book violation. Should have played dumb and “lost my log book” instead of getting hit with a false log violation.
    Why would my 2001 be example if the engine tag says “meets 2000 California emission standards”? However my eld never changed duty status on its own even if I began driving. Also one time I was getting inspected at the Aberdeen scale and officer was complaining that the eld didn’t have any mileage data stored.

    There has been times back in the paper days where it was really good to say aww shucks officer, here is this log, coffee got all over it and the menigure pie just about ruined it. Let's say I don't have anything for you today, you can write me up a fine that way.

    They grumble but I usually get a small fine, pay it and be on my way. What they don't know until they get the money is that there is usually a few dollars extra. Contribution to the teddy bear for kids program and some such.

    It's alot better than that damning log that will and must spontaneously combust when God, er the DOT man touches it. HA... I had one encounter in life where there was a 70 hour rule up in 25 minutes, delivery still 18 miles away across the state line and a Trooper who knows darn well that I know he knows etc. He had to let me go. But...

    He knew. What he did not know was I neatly prefilled that morning's log to make that last hour and half of my 70 hour day work perfectly with my delivery in 40 minutes, pretrip in 10, a half hour to endure problems and the rest of it hoofing to delivery. thankfully that traffic stop only took 12 minutes instead of 30. When I came off delivery I had about 8 minutes left on my 70.

    That is on paper.

    Actual delivery consisted of 3 hours arguing with profanity refusing to break a curbing he demanded me to enter that lot. I finally entered and yes the curb broke. 1000 dollars damage please. Erased the work that crew did for a day previous. I told him it will happen. They never listen. Maybe they listen now.

    When he saw my BOL where those shingles were going today, he understood my position very clearly.

    Those little conflicts got papered over. It would NOT be possible with today's ELD to have had a delivery after a traffic stop like that. Why did he stop me? Well I had been running upgrade at 55. How did I kick that truck to hold 55 upgrade? That's why he was on my bumper auditing my driving to see if he could nail me on speed. And he finally lit me up with a 59 mph run at the last ridge with a two mile pull.

    "Driver, Im on this side of state line today. I will NOT see you over here today. If I did you are ####ed. Understand?"

    I hid out in the truckstop for two days. We did not run 34 hour resets back then. So it was almost three days befroe we got decent work hours out of that recap.

    Just thinking about it, if my truck was exempt I wouldn’t have logged off duty for the day prior. Honestly it was my fault. I figured scales are closed I’m only going to Spokane, should be fine. Guess this is what I get for assuming ‍
    Any thoughts on what might happen to the company side of things? CSA?

    I don't know enough.

    We were never ever taught anything about those company state secrets.

    There is however one folder under the Fleet Managers desk with your name on it. ANYTHING NEGATIVE. NO. MATTER. HOW. TINY. goes into that folder as a write up against you. When they get sick and tired of filling it they fire you.

    DM Bowman had a dispatcher one time in Frederick Ternimal pass the old 76 on his way to work at 4 freaking 30 am. The problem was Blue Circle in Baltimore (Camden) was exactly 40 minutes away for my load pickup, does not open until 630 and I have like a hour and half to eat breakfast, way way way early.

    The company policy was not to run the trucks anywhere but directly to shipper and customer. Poo poo, across town, actually about two miles max with the freaking freeway under my parking spot for a meal. But no Dispatcher Snitch wailed of my sinful behavior that morning to my FM and he drags me to his carpet about it.

    The following morning, I pulled out of that yard at 12:05 am, got breakfast at 12:10 am at the truckstop. Stayed there three glorious hours carousing with the people.

    Those stuffy suits in that outfit should catch fire if they ever heard of that.

    If you let the ticket hit your MVR your car insurance will go up as well. I once had a lawyer who failed to do anything useful, but the other two I've used did get the charge reduced. That false log ticket I got in Wisconsin was reduced to a parking ticket. The driving on a non truck route (disregarding a traffic control device) I got in Pennsylvania was reduced to an equipment violation. I wouldn't just blow it off. It's worth trying. After all, it's your livelihood.

    No he's not exempt unless by some chance the engine model year is 99 but I highly doubt that

    Ok ... hotshot, or car hauler ... you get an oos order and a ticket, no excuse on not updating your log, that the number one thing before you roll ... yes you will have points and you will have it come up on the carrier record ... and your insurance will go up but it will more likely happen at your renewal.

    Any idea what kinda of insurance increase is likely?

    Nope no idea, mine did a 14% increase at the renewal. I and my manager worked with the underwriters to get it back down, but I had three trucks which has issues with OOS and logs, and it was all due to the carrier not setting them up right that was the cause, which didn't matter with the insurance people.

    Insurance increases will personally (To borrow a internet term...) "Flame you"

    One time long ago at 20 I tried to buy insurance for a old ford after it passed inspection etc in Maryland (Imagine that...) The husband wife Agents in there once they tapped my particulars into the computer; sat back and laughed me out of the office saying I will need a thousand dollars to start.

    I ended up getting it directly from the state until my records burned down after three years hence.
