False log violation

    I had a few false log priors - the most recent in AZ in 2004 tough - it never went on my MVR. There go only moving violations, which a false log is not. I also heard from my Progressive agent that this type of violation might be a problem with a renewal. I would still call a lawyer to see if this could be mitigated.

    It is kind of funny to see these types of OOS in the ELD era.

    Even with ELD you can "falsify" a log. For instance, the common practice of staying some hours after pick up or unloading to get your 8 or 10 hours could be a problem, if inspected by a dick. Especially when the facility is forthcoming with information on the BOL - for example Costco, Walmart show arrival time, dock time, departure time. Best to hide that info sheet - or never show nothing - just say "I mailed it already or lost it"
    The lesson for OP is this- never show compromising documents - they don't even need to see a previous BOL, if it has nothing to do with what you got on a trailer. I learned it the hard way too.

    Funny thing is I was smooth sailing when I had the eld. Even had a Chp big bear in a F250 mobile scale get behind me, was doing like 65 before I saw him. He tailgated me for at least 5 miles before I slowed down to 50ish on a slight grade empty :). That was in the afternoon, started in Klamath falls in the morning. Wondering if they can connect to your eld on the fly? When I got pulled over I was doing speed limit in the right lane seatbelt on. Truck was washed in ca not even a week ago, fairly clean. other trucks passed me speeding but he pulled out after me ?

    DOT targets pickup trucks, if you drive a pickup you've got a Bullseye on your back. And once they stop you they don't like to walk away with nothing, they will keep digging until they find something.

    I’ve heard that before but haven’t gotten pulled over before and only been red lighted at the scales once. Which was by mistake, the switch board was broken at the small scale near Aberdeen. He ended up doing a inspection anyways that time, no violations. But that was with eld.

    In dot's defense, very few pickup truck operations require much digging to find something wrong.

    I think this relates as I got a elog violation recently with being overweight. This happened last month.

    The elog had a malfunction. With a gap of no log whatsoever. However when you see in my video when I was looking at my tablet their was logs for that day Feb. 18th! IDK what the heck happened. It sucks but hey it was a learning experience. I think of it now as a test against my career. Regardless I was polite and cooperative.

    We use tablets and if you walk away from truck with it you won't have an elog connection. Idk how the officer could view my logs from his computer but some how he was able to. I didn't email them to him or anything. But he was very very picky on me.Asking me lots of where I was and so forth from a week or so ago. He wanted receipts of fuel, etc, I talk about it in my video. He asked for food receipts. I was like we have per diem so I don't keep my food receipts. But I tried to give him whatever answer I had to help prove my whereabouts.
    I didn't have anything I felt I did wrong. Sucks. So I made this video. Perhaps some of you guy may chime in. I got a warning. And a warning is bad bc you cannot fight a warning. Maybe I can? With this video?

    When you get an OOS violation it can only be disputed through the FMCSA. You have to create an account on their DataQ portal and that's where it's done. I know this because I'm in the process of disputing one from Oregon now. Got stopped at the POE and took my glasses off to see the scale display better. The DOT flunkie saw me take them off and wrote me up for not wearing my glasses and gave me an OOS violation even though I was wearing them as I drove and they were around my neck.

    I’m with Scooter on this one. Very doubtful you notice an impact at all from it. Other than being asked for your logs more often when your pulled in.

    While it is an OOS. If you remain clean, it’ll eventually wash. Having a couple clean inspections in the next year will also help

    This is what I mean. I think Saftey is critical but from what I read online and hear from other drivers. More often the violation drivers receive are hardly actually saftey matters. Yes when a accident happens I’m sure they will investigate, but if you took off your glasses going thru a scale. Or didn’t mark a pick up but clearly just started your drive day after waiting to unload for a couple day, only to be placed oos for another 10. Woke up at 3am tired after falling asleep at midnight. My stop? Spokane!
