It's not being overweight that's discriminated against. It's the lifestyle. Having a overweight driver adds a liability risk that shouldn't be there, especially if the driver is diabetic. If you are physically unfit, you shouldn't be driving, let alone driving a CMV. Also, BMI and your ability to drive falls more into medical examinations, not company SOP. If you can't get a medical card, there's a level 3 violation already. Remember that you're going to be stuck behind that wheel for 10+ hours at a time. This job does take a toll on you health over time, and not being fit is only inviting problems.
Driving is a privilege, not a right. The FMCSA can discriminate against whoever they want 'for the sake of safety' and there's nothing you can do about it. -

Driving is an earned RIGHT. In order to earn the right to drive a motor vehicle you must take both written and driving tests. That is an EARNED RIGHT. A privilege is something that is given. Unless you were given a drivers license without anything expected in return, then it is NOT a privilege. This arguement has been pushed by the government in order to gain control over one more aspect of our lives. A drivers license is no more a privilege than a high school diploma or college degree. All three have the same requirements and MUST be earned. If we allow the government to use a drivers license as being a privilege, then there is nothing to stop them from taking away one's high school diploma or college degree since those can also be considered a privilege. One other thing, most of us pay for a drivers license. There is NO charge for a privilege. -

Once you earn a high school diploma, can the school you earned it from take it away from you?

If the government wants to take it away, they could use the same reasoning. Driving was not considered a privilege until they wanted to force drivers to give up their right to being forced to give evidence against themselves. It was those involved with MADD and other organizations which pushed for legislation which would force drivers to submit to drug and alcohol tests or lost their license and possibly go to jail. We have never been required to give up our fifth amendment right to self incrimination before this type of legislation. I think that most states now have something written into their driving applications which classifies driving as a privilege to circumvent our right of self incrimination. By classifying a drivers license as a privilege they can get around the fifth amendment. With these new laws you don't even need to be driving to be considered guilty and lose your license. These types of laws have always been scary to me. It opened the door to other types of legislation which should be of concern to all of us. I don't want to get off on a rant, but if the government classifies any of our rights or freedoms as a privilege then they can take them away at will. It is wrong.
