I see what you're saying but payin taxes on 40k a year on a 1099 isn't easy. bottom line he shouldn't be there and they shouldn't be paying on a 1099. only way a driver should be working on a 1099 as a company driver is if they're making about 70-80 cpm

Out here in california if you look on craigs list its like 75 percent are paying by 1099. I dont know why the irs doesnt crack down.

it's like another guy said the IRS don't care as long as they get the money they're owed. But that's a horse of a different color. Speaking of 1099's I have to get one still otherwise there's going to be about 45000 that isn't accounted for this year.rachi Thanks this.

Obama and his obamacare are just one more reason many are going to a 1099. Companies simply cannot afford to pay huge costs of obamacare and all the other expenses of employees. It still comes down to your personal decision. If you don't want to work under a 1099 or cannot discipline yourself to save back the taxes, then don't take a job that pays on a 1099. Find a company that will take responsibility for holding back your taxes and write the check to the government for you. But, if you take the 1099, then don't whine and complain that you are being robbed or take advantage of when you knew how the job paid when you took it. If you are not good with money, then don't take the 1099 job. But, if you set up deductions with your bank to take out the taxes and put them into a separate savings account you will have the money to pay your taxes. It isn't your companies fault if you fail to save the taxes from your paycheck. You don't spend everything you earn.

I haven't read every post, but I can tell all you guys this. Don't listen to the guy saying the IRS doesn't care, the IRS does care and wants to know!!! They are losing money from the employer not paying into the system.
If your employer pays 1099 you can call the IRS and make them file w2 and they will have to pay all back taxes and probably will get a huge IRS fine too. Here in Florida craigslist is full of these jobs from small companies mainly owned foreign people. The back taxes and fines alone may put many of them out of business.
If anyone runs across a company doing this CALL THE IRS! -

Sure if you don't want to have any credit for SS, or workers comp, Medicare, or benefits from an employer who is paying you legitimately. Not to mention the best part: you will even be in the same boat as your employer to the IRS for back taxes and penalties if your employer is caught or ratted out by someone else.Last edited by a moderator: Feb 25, 2016
