There are so many things that are now criminalized or gone from a misdemeanor to a felony. I think these prosecutors will throw extra charges onto a case in an effort to get the defendant to plead to the charge they wanted in the first place. Defending yourself is expensive. Having any criminal record in the U.S. can make it difficult to cross the border into Canada. A DUI is considered a misdemeanor in the U.S., but a felony in Canada. You can be convicted of a DUI in the U.S. by refusing to give evidence against yourself. You don't even need to be driving to be convicted. Some states, such as New York, can charge you with a felony by having a gun in your possession if the ammo is near the gun. The gun doesn't have to be loaded for them to consider it to be loaded, depending on how close the gun is to the ammo. I could go on, but the point is that I would not be too quick to judge anyone who has a criminal record. Many things are now criminal which should not be criminalized. It is about the money.
I remember back in the 1960's, if someone got into trouble and younger, they could be given an opportunity to go into the military or go to prison. Most went to the military and turned their lives around before they had a criminal record. I think those people had more common sense. All we do in some cases is turn a first offender into a habitual criminal. We throw them in jail or give them probation and then make it next to impossible for them to rejoin society. If they cannot work and become accepted, they will do what they must in order to survive. Unless we help them with a job then they could turn toward criminal behavior.
We have a lot of people sitting in prisons who should not have even seen the inside of a courtroom, much less a prison. When it comes to justice in this country, unless you have the money to mount a vigorous defense, you are more than likely going to either go to prison or come out of the court with a criminal record.

G-Man this beer is for you! Well put. I am not a felon but have seen many people get screwed by a broke system! This is one thing I hate about American, Quick to Judge, All about me, And anyone can lie and demoralize. How many cases have succeeded in Defamation or Libel Lawsuits? Our Government sucks a fat one when it comes to Criminal, Offensive, or Legal terms. I see people carrying kids without car seats in the front seat, or kid is super overweight from eating everything the parents buy them, or parents smoking with all windows up and kid in car. That should be considered Child Abuse rather someone teaching a kid right from wrong using corporal punishment! All the sissy's in this country cry don't spank kids. Has anyone really taken a look at some youth today? Very Disrespectful talk back to parents, teachers, etc. Just IMO
I think everyone should be required to join a branch of military for one year! You will learn values! -
In recent years I have seen a number of incidents where people who were convicted have been cleared with DNA or other evidence. In some cases, people have come forward and cleared the one who was convicted. Don't get me wrong. There are some bad people in this world. Many of them are sitting in prison. But, there are also those who are wrongly convicted of crimes only because they don't have the resources to pay someone to defend them.
I know a lawyer in my town who got a lot of people off for criminal behavior. I am sure some were guilty, others were not. He played golf and socialized with judges that presided over his cases. I recall someone telling me once that he could often get someone off when no one else could. He is now a judge. From what I was told, this lawyer charged a very high fee for his services. If you could afford the rate, you were nearly guaranteed to get off. I can't say whether that is true or not, but having known this same lawyer's father, also an attorney, I think it is possible.
A lawyer who has a relationship with a judge can often make a difference in the outcome of a trial, especially when there is no jury.
There are laws on the books that really concern me. One are the implied consent laws. The other are gun control laws in some states. Both violate the constitution, but people are convicted, nonetheless. -
wow. I am not sure how to respond to this thread. i came to it looking for some great insight into finding a job since i have a record.
So let me clarify.. I DO NOT have a felony! I was arrested for a felony charge, when i went to court they reduced the charge to a misdemeanor. however, when you pull my criminal report it says Felony, until you look at the disposition where it states that conviction was misdemeanor. I have applied to more companies than i can count and i have been turned down by them all. so i came here to get some insight to what i might do.
let me clarify something else, my last charge was over 8 years ago. I voluntarily spent over a year in rehab and I have been clean for over 7 years. I recently got married and had a kid. I also adopted a kid. I have my class A with all endorsements including Hazmat. so the government says I can haul hazardous materials but trucking companies wont even hire me to haul dirt.. i dont see how this works. I am not the same person i was back when i got in trouble. not even close! I am a hard worker and all i want to do is have a good job so i can support my family.
I am not saying that all criminals change, but when you see one that clearly has why not give them a second chance? -

"There are companies out there that will hire felons" I know, you already know that. bottom line is get off your lazy ### and make some phone calls instead of coming to this site trying to go the easy way. if you have a felony on your record you already know that it's gonna be difficult. deal with it and stop bellyaching to everyone that no one will give you a chance. they will if you're up front and honest about it. i should know. I have a felony that is 29 years old and i still have to explain myself every time. embarrassing as it is to say you have one, it's worse when you say nothing and get found out. if your felony is less than 10 years old your chances are slim to none. and if it's a violent crime felony no matter how old, same thing. slim to none. that's life and it's not gonna change anytime soon. no matter how many times you come back to this thread!

If you were convicted of a misdemeanor then felony should not even be on the report. Only the conviction should show up. You stated earlier that you had a felony. Now you state that you were charged with a felony but convicted of a misdemeanor? Did I miss something? A misdemeanor will not usually prevent you from working in this industry, even a recent conviction. Either it was a felony conviction or it wasn't. If you don't have a felony conviction then you should not be telling companies that you have a felony. Anything drug related is likely to cause some problems in this industry, especially if it is recent. Depending on the circumstances, you should be able to find something. If you were not convicted of a felony and it is showing up then you need to get your lawyer to look into it and have it changed.mmffdvrr Thanks this. -

Hmmm, I musta missed something cuz I don't believe anyone was putting you down. My response was not directed to you but rather to any one with a felony on their record.
Only one way to find out who will or who won't hire you is to make the calls, no matter how many you have to make. Every situation is different and what works for one person will not necessarily work for another. It only takes a few minutes with the recruiter to know if you even have a chance with their company. Just keep trying. From the sound of it, you should have a better chance than most.
I have tried more than most to find work.. i even spent my taxes to travel across country to meet with potential employers in person.. everyone said no so far.. but fortunately i dont give up very easily... as for all you people trying to put everyone down.. I would say these felons who are trying to improve thier lives and become better people, trying to get a decent career, they deserve these jobs more than you pricks!!!! you all say they dont deserve a second chance.. that such bull.. i have met recovering addicts with more dignity than you could ever have. more strength than you could even imagine.. these are people who are giving up everything in thier lives to become better people, and people like you wont give up anything to change.. im sick and tired of people putting me down because i made mistakes.. i am soo glad all of you are perfect and have never made a mistake before..[/QUOTE]
Think about this too; If your felony/misdemeanor charge was drug related your chances are slim to none. It's not a question of whether or not you have turned your life around. It's the economy. There are too many people out there with no job and no record so the trucking companies can simply pick and choose who they want.
