I was hit by another truck at the truck stop parking lot. He parked the truck and didn't apply the brakes. Long story short he hit me in the nose of the truck causing damage to hood and bumper only.
The trucking company wants me to get an estimate and avoid going to insurance. I did and I will send that to them on Monday. (i'm waiting to make sure there is no other damage found under the hood)
Don't know if it matters, it is a large moving company.
My questions are...
1. Is this ok? I never had this problem before
2. Can I charge them for lost productivity? What about driver lost productivity? We only own one truck.
3. Anything else I should know?
This is my first time having this issue and your help is appreciated.

As an employee you can't charge them anything. As a company they should give you breakdown pay and put you up in a motel. Being one truck they will probably try to offer you zilch. I would ask your boss ahead of time, "am I going to receive breakdown pay? Are you going to put me up in a motel?" It takes time to get an estimate, drive there, make your way to a motel, etc. This isn't volunteer time. Get me home and you take care of it if you expect a gimme.
Something isn't making sense. The other guy's insurance is suppose to pay your company. That should include any compensation to you and them for lost revenue. Be firm, but not ugly with them. Most driver's would get $50-100 a day and a motel room.
Last time I had my hood/bumper and radiator murdered, it took two weeks to get it fixed and I got a loaner truck. The shop was near our terminal and someone in the office was related. Most body shops are backed up with a long wait. Ask them, you might want to go home until it's fixed.
Let's say it's going to be a month or two. If he holds out taxes and pays unemployment like he is suppose to... you could go home and immediately file an unemployment claim. The first week or two would be a bye, but anything after that you could draw a weekly check. It's better than nothing. With that said he should give you breakdown pay. Being a new driver try to get at least $50 a day. I'm pretty sure he is being compensated well. Don't let him pull wool over your eyes. -
Don't have the answers to your question, but I hope all turns out OK.rickybobby Thanks this. -
Depends on if its your truck. I went through the same thing with Swift. I was waiting to exit the truck stop and his truck cam rolling into the side of my trailer. He didn't set his brakes. It was obvious what happened, and thankfully there were witnesses. I went straight to Swift themselves got an estimate, also an estimate on the amount of downtime it would be. They paid no problem .
BTW, police will not come onto private property and do an accident report(I.E a truck stop) at least in some states they wont .
Yes it matters on the company type that hit you .many are self insured ..comoes3 Thanks this. -
Police report and as many phone# and info on others that saw the acc. they could say the truck was 500 mi. away if it is only your word and you dont have police report.
-
Yes, police will write a report on private property, if asked.
-
It really isn't private property, it has public access so that makes it public property at that point. Some states may have restrictions on that rule but the cops should always go out and see what's going on no matter what, mainly because when was the last time we have seen a $50 fender bender on a truck?
-
It is private property and I doubt the states have anything to to with cops on the property. Truckstops don't want them there unless it's an emergency cause it's bad business. Would you want to stop at a place that let's dot pull you out and run inspections in their lot. I'd never spend a dime in a place like that and they know that. If dot was allowed to write tickets in private lots you can expect to see for sale signs up pretty quick cause business would go elsewhere.

Wrong, I remember back in the 70's Triple T at Tuscon let the DOT boys come on their lot & check out the truck drivers. There for a while they lost quite a bit of business.
Yet if there's an accident where there is property damage, your truck is damages, most truck stops has no problem with the local police come on their lot & making out an accident report.
And not asking for one is a good way to have your truck damaged & having to repair it yourself, that can be costly. -
You pretty much proved my point so I'm not sure how You think I was wrong. Although I didn't spell it out for you accident reports are kinda a given when they occur. A lot like emergencies or even when they get called out. They have to investigate it then.
Do I need to elaborate. Yes they won't have a problem with them coming for anyone that calls but I'd be willing to bet they don't want them on the lot checking trucks. Triple t is a perfect example and they learned the hard way it's bad business to allow it. Right.
