Fines for owner operators by the companies for violations

    OK here is the thing, you can't legally fine them for violations or anything else for that matter - PERIOD.

    Those companies doing that can be sued for this, even if it is in the contract, there is no way to hold a contractor liable for your safety score, you can't fine them, mess with their settlement or anything like that because the law is on their side when it comes to agreement of compensation for work.

    You need to get a lawyer who can create a contract for you, and it can't have this crap in it.

    Sorry, might be just bad wording. English is not my first language. I try my best to treat people that I work with the respect that I'd like to get from them as well. I drive still occasionally and know how hard the work is.

    The owners do get a pecuniary reward when passing the check up without issues.

    If they can't pass levels 2 and 3 without issues, there's problems.

    I did not mean to imply that you are a bad guy or that I am judging you.. I can understand that wording can come out incorrectly, especially if English is not your first language.

    I think that's great that you treat your guys with respect and that you understand how hard the job is.

    I think what you are trying to say is that you want a way to make sure that the rules are enforced and everyone does what they are supposed to, because in the end it always comes back to the MC.

    Really though, I think that it is about clarity in making extremely clear what you need from your guys. Maybe something to the effect of, "whenever you are inspected, ticketed, (whatever),
    You have three days (or however long) to report it and if it is not reported then X happens".

    You need that type of clarity so everyone is on the same page. And it makes things so much better for everyone because no one has to guess or wonder.

    When it is time fire the bad apples, and the others will fall in place.

    So how does notifying the carrier about a warning going to benefit the carrier per se? What is to be gained with such knowledge?

    If you get a warning it applies points just like getting the ticket to the driver and the carrier. The only diffrence is there is no fine and you cannot contest the warning in court. But you AND the carrier still get the points.

    So it is his buissness.

    How does being notified about it by the contractor benefit the carrier?

    It's really a requirement to notify the carrier of the inspection and if the carrier needs to take further action. Altough if it is a traffic ticket, he doesn't have to notify anyone, but if it is an inspection thne he has to.
