fire ext "readily accessible for use"

    From 393.94: "(4)#Condition, location, and mounting.#The fire extinguisher(s) must be filled and located so that it is readily accessible for use. The extinguisher(s) must be securely mounted to prevent sliding, rolling, or vertical movement relative to the motor vehicle."

    My truck's 10bc bottle is mounted in a locked luggage compartment behind the driver's door. Every other truck I have has had it mounted next to the seat, or in a luggage compartment opened by a handle next to the driver's seat -- both accessible without a key provided the door is unloacked. But in my current truck you absolutely need a key to gain access since the compartment is automatically locked.

    I also have a load lock that rests against it because there is no other place to secure the ll than in the under bunk pass-thru.


    Do either of those disqualify my extinguisher from "ready accessibility?"

    I just had a L2 inspection in MD. My extinguisher is in the compartment below the bunk, accessible through the sleeper emergency exit door - which was locked at the time of the inspection. I carry a separate set of keys in my pocket, so when the inspector asked to see it, I simply pulled the keys from my pocket, unlocked the door and moved my work boots from in front of it so he could see it. I'd call that 'readily accessible', and the inspector never batted an eye.

    The only problem I could see is if it's not in a mount, the load lock holding it is place won't qualify in my book. I've got a 5 b.c. extinguisher mounted under each front seat so I can open either door and grab one. I also have two in the trailer. (I pull an enclosed car trailer.)

    It is in a mount, its just that I would have to hold the load lock up, or drag the extinguisher against it if I had to pull out the extinguisher. There should be plenty of room, but whoever installed the bunk heater conspired with the qc installer to ensure that there was no straight shot available in the pass-through except for the spot someone decided to mount the extinguisher...

    I think it would be a ########### ticket, but possible. Just something I wondering after reading the hazmat guidebook while trapped in canada without phone/data service.

    my last truck was mounted in the compartment door. no key to open. but with all my equipment. (flatbedder). i have to move things and unmount the fire ext. only had one lvl 1 with that truck. only thing leo said was that it's expiring. (weak).

    truck i had before with a different company. was mounted between the drivers seat and the door. on the floor. i hated that thing cuz my feet were always hitting it when i climbed in and out.

    One place I was a company driver for in the early 90's had the fire extinguisher mounted right behind the sleeper on the frame rail. I guess that would be readily accessible even by someone who was trying to put out a fire after the truck was wrecked and driver unable to do anything. Seemed like a good idea at the time. Never had a problem with it there and no one messed with it. Probably wouldn't be the case today.

    I am a CVSA certified inspector and it sounds to me as if you are in compliance. I would mark you down with a violation IF the fire extenguisher was rolling around unsecured in your sidebox or, if for whatever reason, you could not get your sidebox unlocked or open to show me the extenguisher. Otherwise you should be good to go. (taking for granted it's charged)
