Fired for off-duty alcohol need advice!

    He messed up, but .018???? That's mouthwash. Someone was a ##### and ratted him out for what he did on personal time. That's not cool. Here's to a better job.

    1099 is a PITA. Many companies are going that route as it frees them up from filing W2's. I ran into a lot of trouble with a 1099. You have to pay quarterly (every 3 months) taxes out of your take home pay and if you don't, you get charged penalties and interest, and believe me, the taxman has no sense of humor, they mean business. I would never work for someone paying me on a 1099 again. And I'm not the sharpest knife in the drawer, but these tax laws are so confusing, you need an accountant to figure it out.

    Tell them you violated company policy by not remaining on the DC property as you were told to do. You left to get a hot meal instead of eating junk food in the truck.

    I asked our teacher this exact question and he said just dont put those truck keys in the starter and there would be no issuses. I work for Millis.

    So this situation raises an interesting question. CRE fired him, not for the alcohol consumption, but for leaving the truck and the DC while on his 10 hour break. If CRE required him to stay with the truck, then he would not have been on his 10 hour break, he would be required to log on-duty for the entire time that he was required by the company to stay with the truck. So CRE is pushing drivers to falsify logs?

    Not to mention that the company violated the rule regarding when an alcohol test could be administered.

    OP might have a case against CRE on this one. Can't hurt to draft a demand letter for a settlement. They might just pay him off to sweep this one under the rug...

    I understood he was fired for being on the customers property with detectable alcohol in his system. Has something changed?

    `123456...How can our instructor have Millis policy wrong? Our policy is same as DOT, the person in question was on his 10 hour break, mandated by the regs, its your time....once you gst back to duty then your BAC better be below the levels...a person is still allowed to have a life.
