Fired on day 2 of a new job?!?!?

    Just a bit of Devil's Advocate here. I've not seen an application that asks about current charges. All I've ever seen is "convicted in the last x years"
    If you didn't ask about current charges then him not disclosing it would not be a lie.

    Of course you had plenty reason to fire him anyway....

    I always ask about anything pending in the interview. Pending in and of itself is not necessarily A disqualifier, I just want to make sure that it's settled first.

    That's just plain stupid, current charges are part of the last x years. Smart people recognize that x years back equals today and back x amount of years. Why would he have to specify "current" charges?

    Because one might actually not be guilty. Or more likely enter a plea bargain for probation so that after x time it's not seen as a conviction...

    That's all according that this is a criminal case. I don't recall it specified, although it might have been.

    Heck it could simply be a child support dispute. Or a non moving ticket, or a number of other reasons the company doesn't need to know about short of needing the day at home.
    Not saying that's the case for the op. Just saying there are plenty of times one could go to court and it not be the compaines business.

    As it turns out it was a criminal case. Regardless if it's criminal or civil I'm not going to bring somebody on until the matter is resolved.

    It’s your co so you become at risk for your drivers. But maybe since no one found out but you, would it be fair to give him pay for the mileage he drove and still let him go? I don’t know his situation but everyone is working bc they need $ to survive. Unless the authorities found out, then yes keep the load.

    For the amount he drove he was owed $90. Once I took out the recovery cost, drug test, and cleaning he owes me $587.63 Should he wish to make a big deal of it, I will be happy to bill him.
