How else does anyone cover their ###? You take pictures, keep notations of phone calls to the truck stops and who you spoke with about parking. Its not that hard.

We - my legal advisor and I - were discussing this issue this afternoon and one thing he mentioned is if PC is used and there is an accident, the company can let the driver hang out to take the heat.
Also a couple things.
If we are talking about laden PC, I am betting insurance companies will start to take notice and push the FMCSA to either define it without a laden PC or eliminate it altogether.
States also do not have to accept this, they have to say that they accept the guidance, it isn't cut and dry because the states are in control. -
So you stop. Take pictures of the entire truck stop, then proceed?
Or you take the word of the girl in Flying J that can't even keep the coffee pot filled up?
Truck stops would never take on that liability either.

I don't see it as being all that brilliantly disguised.
What I do see, glaring, anyone that does this is, has now opened themselves up to bear's discretion, and you know that's not gonna go in your favor.
I mean since e log came out, violations plummeted, now guys are getting cited for mud flaps sailing, and marker lights.
