In 2021, I went for a pre-employment drug screen thinking that the 30 days I waited was enough to clean out my system but there were small traces in my system so they failed me and reported it. So I go through the process of getting a sap to begin my rtd process. I do all the steps, get cleared through clearinghouse, and continue to drive for 3 YEARS! Well today I get an email, 3 years later, stating the person I went through wasn't in fact qualified to be a sap provider and it's because he reported everything in the same month. Now the clearinghouse is forcing me to restart the entire process over again. I don't feel this is fair seeing as it has been cleared through the clearinghouse for 3 yrs and I'm not the one who reported it wrong. Why is it my fault? Is there anything I can do?
I saw the tag. I am not feeling very well. To be honest there are no appeals procedures in the regs. If the OP has been told they must go through the SAP program again then sadly it looks as if they will have to. I wish I could be of better help, but as I said I don't feel well and my brain is not functioning fully right now. So I am going to tag @brian991219 maybe he knows something I have missed.
If your CDL had been issued by a school that had authority to self-test students and you drove for 10 years. You could be forced to retest for the CDL. It is what it is. There are enough obstacles in life without adding to them. I'm glad you turned things around. That's the most important part.

Thanks M. Unfortunately for the OP, if the email they received is legitimately from the FMCSA then they may be required to start all over again. It is important to note that the FMCSA is not in the habit of making first contact on critical issues via email, they prefer regular postal mail, so this may not be a legitimate notice. I would contact the FMCSA Field Office or Regional Service Center where the OP lives to confirm this is legitimate and to see if they gave any grace period to comply or if they have already been placed in prohibited status in the Clearinghouse. Thank you for the help! I just think it's totally unfair for the driver to be punished and forced to restart when it wasn't their fault. Especially 3 years after the fact... Not 3 weeks or even 3 months. 3 yrs.. And I had to pay this person. Now I have to come up with the money to do it all again.
