Hello, I'm currently on this load it's been mised communication between broker and receiver . Broker informed that it would take 4-5 hours to unload trailer NOW receiving informed me that it can take 2-3 weeks . As a single truck and trailer company I can't leave my trailer for this long.
After trying to get a hold on every possible human involved, I'm still outside the receiver waiting for brooker instructions . It's now been about 10 hours and no updates . WHAT OPTIONS DO I HAVE HERE ? HOW LONG DO I HAVE TO WAIT FOR BROOKER AND SHIPPER ? if I drive this load back to shipper (10 minutes away from home) can I still fight for my payment?
THIS LOAD IS FROM PA TO NJ .

You could try asking for their updated rate con stating 100$/hr on detention, take pains to mention that at the quoted 2-3 weeks that will be 33,000-50,000$

Huh? Oh ,that's what the ports and receivers are doing, sitting on everything for 2 weeks to 2 months to drive the price up .truckdriver31 and dwells40 Thank this.

Depending on the port, they want the stuff gone yesterday, Long Beach and L.A. sent a message to the truckers and the railroads last week, 3 days to remove rail cans and 7 days to remove truck cans or $100 per day storage.BUMBACLADWAR and truckdriver31 Thank this.

Well I have been through some of this and there is a couple of things.
The first thing is that you have to email the broker and have it documented that you have been emailing him and trying to communicate. You must do all of your conversing through email and download a recorder app for your phone and let them know they're being recorded when you speak with anyone shipper receiver broker whoever because now you need documentation.
I would also call the shipper directly and see if there's any way that they will accept it. Taking it to the shipper does you no good if they won't accept it.
I would also call the transportation attorney because there are some loads that if you put them into storage it's immediately a claim and I don't know how all that will work out for you. You absolutely should have an attorney advising you on what to do because this can get hairy.
To get the broker to answer you this is what you say. " I have made every attempt to reach you, I've been attempting to reach you for 10 hours, there is no response and there is no direction for this load. Therefore I have no choice but to take this load and put it into storage because I cannot receive any direction whatsoever to do with the load."
Now you can also call ooida if you are a member and they will send you a warehousemen's form that you can include in the email and that form just basically says if I don't receive Direction on this load by such-and-such time it's going into storage.
Within a short period of time you will get a response from the broker because if he does not respond to you and you put that load into storage then that's on him for not responding to you.
Then he's going to tell you no no don't do that we're working on it we just haven't received a response yet...
Then I would tell him that I've been there for 10 hours I've received no direction and I'm going to give you one more hour and at the completion of that hour I'm leaving. By the end of that hour I need directions on what to do with this load or it's going into storage.
They will call you back within that hour and try to plead with you to do whatever but unless they tell you they're going to unload you in the next hour or at cetera excetera, leave. You can even tell him you're taking the load home with you but get out of there because you're just wasting your time.
They probably are going to tell you that they'll try to get you another appointment within the next however many days just wait blah blah blah and then they're not going to want to hear it when you give them your terms for storage and everything else.
They will probably tell you that they'll pay you to redeliver it but they won't tell you what that rate is they won't want you to set the terms for that but they'll tell you "they'll take care of you". They may even try to get you to deliver it without a new rate con. Never ever ever ever do that. Whatever they're going to give you for that it has to be clearly outlined in a new rate con or that load can't move because you're going to eat it.
You can also take the load home and then send them to warehousemen's form saying something to the effect of I'm charging this much to redeliver it this much for every day it's in storage if I don't receive a new rate con Within 12 hours from now whatever the case is the load goes into storage.
This is where they will tell you you're holding the load hostage and you can't charge them whatever you feel like and there's probably something that you signed any agreement that sort of said something to that effect so again you need the lawyer.
Make sure that you stay in communication with the broker let him know you're taking the load out of there but from that point you really need legal counsel to tell you what to do.
I live in PA I do a lot of loads from PA to New Jersey and it might even be the same company and the same situation that happened to me.

Send a revised rate con advising broker of your rate for A.) Cost per day to hold your trailer for 2-3 weeks B.) Invoice for your cost to rent a trailer C.) Rate to return load to shipper. Send original rate con with time to unload circled to remind them that this is their mistake. Do not leave your trailer at receiver until you have a resolution in writing from the broker that the receiver can confirm!Rideandrepair, truckdriver31, tscottme and 1 other person Thank this.
