Get fined for being in sleeper too long?

I get the impression they (some) are challenging staying in the sleeper for 8 hours. Get out to pee at hour 6? Better go Off Duty [and interrupt your break]

But again, I need to get some context as to what they are trying to say happened to some of our drivers recently. I just can't comprehend rolling over and accepting what it sounds like they are alleging.

Each officer will use his judgment or policy to decide. The FMCSA regulations do not mention excess time in the sleeper. The most likely way to get a ticket for "too much time in a sleeper" is to never show on-duty time at a customer, ever. An officer is not going to believe you never have to check-in or talk to a customer to get loaded or unloaded.Airborne Thanks this.

I got that in Alabama . Didn't like that I was in sleeper after showing on duty 15 at shipper. Asked me, well what are you doing when you logged sleeper....I said I'm actually in the sleeper laying down.

A friend has his sleeper setup with everything he needs, even a mini shower, his work would have him setting for a few days at a time at shippers where they would process products and he would take it back to where he came from. One day he was pulled into a California scale and the cop inspected his logs. He had four days logged sleeper at a shippers location. The cop said he was lying "no one can spend four days in a sleeper at the shipper" and he said to the cop "I worked in it, I had a cube where I spent 14 to 18 hours a day and never had an issue, so I can do four days without a problem" then he told the cop he is welcomed to inspect the sleeper and especially the toilet because it has not been emptied yet and there is a lot of proof in the tank. The cop let him go.

So, in that cops mind, if you're at a rest area needing to do an 8, and you have to take a crap, you can either crap your pants in the sleeper or make a line to Off Duty and void your break? Seriously?
Don't forget to log the 3 seconds Drive time as you sit in the driver's seat as you're exiting the truck

Going from sleeper to off duty does not void your break. In fact your not even required to actually sleep while on your 10. I know you know that and the LEO would learn that in court. Hope that sounds right.
