    Wrongfully terminating somebody because they used FMLA is illegal and could cost his former employer a lot of money if he'd lawyer up.

    "claiming I took too much time off work" OP does not say how long he was off work. FMLA is up to 12 weeks. If he took off more than 12 weeks then the company was not in the wrong legally.

    Yeah, but you have to CLAIM FMLA first. I kinda get the feeling he just missed work a lot, which is different. I'm not a lawyer (even though my grandfather was...), but then neither are you.....
    Regardless, just being "flaky" about showing up to work ain't "misconduct" in anybody's definition.

    No we're not lawyers I'm just taking him at his word he was on FMLA. If that was the case and he was playing by the rules then yeah he was wrongfully terminated. Granted drivers tend to gloss over and leave out a lot of relevant facts when posting stories on here so yeah he could have been terminated for just be a slacker.
