Regardless, just being "flaky" about showing up to work ain't "misconduct" in anybody's definition. -
No we're not lawyers I'm just taking him at his word he was on FMLA. If that was the case and he was playing by the rules then yeah he was wrongfully terminated. Granted drivers tend to gloss over and leave out a lot of relevant facts when posting stories on here so yeah he could have been terminated for just be a slacker.
