You can do that, lots do it, I’ve done it, but is against the regs. Might never get caught. Have a serious accident or god forbid a fatality and let a truck hating ambulance chasing POS attorney explain to you and a jury of your peers why it is not legal to do it and how your falsification of your RODS made you kill that poor person with your sleepy arse behind the wheel of that nasty mean old truck

 

This is why I log 15mins on duty then log the rest as off duty. Every dock worker gets a heads up. “Hey I’m gonna stretch my legs” or “I’m gonna take a nap wake me up when done”

 

And which of these state you have to be on duty when someone else is unloading your trailer?

 

My understanding is that the word "attend" doesn't refer to all time spent at a dock. Theres two dictionary definitions, one is to be present, the other means to focus your attention. Using the latter, you can be in sleeper on a dock just as you can be in sleeper at a truck stop, as long as you're not unloading it yourself, don't have to be on the dock to count, etc.

The way I was taught is that when you're at a dock you should never go straight from drive to sleeper or sleeper to drive. There should always be some on duty time in transition. You have to attend to the vehicle to prepare for loading/unloadind/driving, but not necessarily the entire time. When they knock on your cab to give you papers is when you go back on duty.

 

Just hop in the sleeper and go to sleeper berth.

 

Man this stuff will make an aspiring truckers head spin. Guess this is another thing I need to add to the already long list of getting a better understanding of HAHA

 

Sleeper berth is not "remaining in readiness to operate the commercial motor vehicle, or in giving or receiving receipts for shipments loaded or unloaded." As you are resting. Not remaining in readiness.

 

Not what the reg says.

 

And yet no specific wording to support that statement.
