As an independant I have found a solution to the poor work and overcharging the dealerships hit indy's with.... Many times the dealers do "make work" to inflate their shop bill and bottom line on our backs. So after following a proper complaint process up through the chain of command and being offered a "discount" on my next service, my attorney suggested that I file a small claims lawsuit against the dealer. I did and it worked.

Filing a small claims lawsuit against the dealership and they settled to my satisfaction. But make sure you have all of you ducks in a row before you do this. My attorney could have gotten the same results, but he suggested I use the small claims route, since I had winnable case and didn't need to use an attorney.

There is a list of truckers that are black balled! After this, you might be on the #### list and might be denied service with a, we are too busy kind of excuse!

Did you read your settlement? I'm sure that it contains a 'no future business' clause - you can never do business with that company again.

This thread is sort of worthless without details. What exactly was done wrong and how did the value of the future discount fall short enough to sue, even though you accepted it?

Don't get me wrong, I've had my wallet peeled by a few dealerships. The last time I took a mishap up the chain, it was for redoing a bunch of teardown to fix something a second time the tech should have easily spotted the first time. The discount offer was for two free PMs. The value was equal, although I wasn't real happy about paying now for service later. Nonetheless, it never crossed my mind to go sue them anyway after accepting the discount.

Exactly...... I can understand windsmith's confusion as he is just playing trucker without any investment of his money in the business.

I cannot name the dealer due to the confidential settlement agreement i signed. I can only describe the situation in generalities as not to violate the agreement. Just pointing out to others that one does not have to bend over and accept it. You can fight back.
