I would like to know if anybody can give me some advice, on a situation that I came across not to long ago, okay it went like, I just started a job around 45 days ago,and I got sick outside of the job and I had to stay in the hospital for 4 days and the doctor had wrote me a letter, stating that if I were to go back to work I was only able to do light duty only for about a week and then I would have to go back to the doctors for a check up,can the company fire me from my job. thanks.
most everywhere these days is right to work you can be fired for anything anytime doesn't make it right so many jobs driving everyone needs help employers are not as quick to let drivers go
Sorry to read about your bad luck pards. Go to your State Department Of Labor website. There should be enough info to point you in the right direction.
You could be a 40 year employee, go to the hospital for an operation and get canned. Why? The company can say you are "damaged goods" and a possible liability. Sad, but true in as was already stated, a "right to work state". Now if you are a union employee, (I know this from experience) your job is secured till you are released from the doctor. In EITHER situation, the company CAN MAKE YOU take another DOT exam! But in "general terms", a doctor's note usually saves you. Get better soon! Oh, and "PS", sometimes many companies DO NOT HAVE, "light duty"! SO ask your company, and if they say NO to any light duty being available, I mean since you ARE a truck driver, you would be expected to drive, then have your doctor write you a note saying how much time you will be out.
I have a question about right to work laws....if the company can fire you at anytime... Can the employee also quite at anytime without notice?
I would thank you for your post Mr Anthony but I see you have been thanked 666 times ... uh no ... no ... no ... no ...noooooooooooo. That may be worse than steppin' on a crack or walking under a ladder. On another note, I have seen people let go by a company after being on medical leave for 6 months with terminal cancer. The company drops their medical insurance and yells them to go on COBRA ... even if the sick indivisual is the only wage earner in the family and unable to pay such huge amounts to COBRA. Incredible ... absolutely incredible ... that any company would do that to a human being ... but they do it and it's perfectly legal.
Anybody can quit at anytime, this isn't slavery ... it's a free country. However there may be ramifications for just up and quitting without notice.
Actually, those that have posted, referencing "Right To Work laws/states", are incorrect. It's often mixed up, but the CORRECT applicable laws are those states that are "AT-WILL" states. You need to tell us what state you are in, and look up labor laws for that particular state. If you live in an "AT-WILL" State, then they can basically fire you for not liking the wrinkle in your neck. Or any reason they want. Exactly....... I am getting a heavy dose of training on this subject through my HR rep at work. Virginia is a right to work state with certain workers rights that are not available to workers under states that support "At Will".
