Got a cell phone citation and level 3 inspection.

    By turning it over to Road Law, or Interstate Trucker LTD, or a local lawyer who handles CDL tickets, the main benefit is that you can stay on the road earning while the lawyer handles it it court. In my experience, whenever I or a lawyer appeared before a judge, the violation was pled down and the points removed.

    It's no guarantee. But if you just mail it in, you get the points AND the original violation. So, to have any shot at all to reduce the ticket, SOMEBODY has to represent you in court.

    So are you saying the company isn't allowed to fire you while the lawyer is getting everything situated

    I agree he needs to speak to safety ASAP.

    I took his post to mean he got a separate traffic citation for the phone violation. I was thinking MVR points, forgetting that there is now PSP points.

    So, yeah, if it's just an inspection form, you might already be screwed. If it's a separate "Uniform Traffic Citation", go to court.

    I have both. The only issue is the inspection form has the citation on it too

    That should be the case, but not necessarily. But if they dismissed you as a result of this, and you later get the phone use citation dismissed, they may have to pay you back lost wages and rehire you if you really pressed them on it.

    No, that's not what I'm saying. You are an "at will" employee, most likely, able to be terminated at will.

    If they DON'T fire you immediately and let you continue to run, the lawyer is handling it, so you don't have to turn down any loads because you have to "Get home to go to court".

    If you get fired, you have plenty of time on you hands to represent yourself. Maybe go down a few days early and observe traffic court. Try to get a read on the judge. See if you should wear a suit, or clean "trucker clothes". Observe what kinds of behavior piss off the judge, and what kind of behavior softens up the judge. Knowledge is power.

    You still might not get your desired outcome, but you'll have given it your best shot.

    Immediately get a attorney from the exact area that it happened and pay him whatever he needs. He will work a miracle for you more than likely. Do it now.

    My friend won't ever go to Wisconsin again....he says they interpret the rules however they want....he is a 20 year O/O.
