Got a cell phone citation and level 3 inspection.

    while I agree with most of this advice I will add this advice as well you'll also need to weigh up the costs of the lawyer v the cost of you fine if u really were using your phone then just man up and cop it sweet, paying a lawyer will cost a pretty penny so will his cost out weigh the fine that will be your dilemma.

    I agree with ya, aussiejosh, to a point. If OP is gonna get 4 DRIVER'S LICENSE POINTS out of this, rather than just PSP points, he needs to CAREFULLY EVALUATE his next move. License points can affect OP's employability for the next 3 to 5 years, and may affect his POV insurance rates.

    If he doesn't go to WI to represent himself, or hire a lawyer to do so, he has ABSOLUTELY ZERO chance of having the points reduced or removed, or the original citation pled down.

    This is about damage control, not "manning up".....

    That sucks to hear, dude. Definitely lawyer up. It doesnt matter how guilty you were, traffic lawyers are very good at damage control and can even make miracles sometimes. Do a google search for traffic attorneys out of whatever city or county the citation is from. You will pay them a fee to show up in court on your behalf and "work their magic". Usually they will just plead a "no contest" to the citation and the judge will decide what he wants to do. If you have a good driving record, you might get better results. But ultimately, its a crapshoot ... you could very well pay the attorney and end up still having to pay the ticket and court costs if your judge is in a pissy mood. Also, I know in Florida if the cop doesnt show in court the citation gets automatically dismissed.

    I got cited by a city cop for doing 66 in a 55. Called an attorney, paid him $150, and he got the ticket dismissed without me having to miss a day of work. He told me before the court date that the judge I got will almost always reduce cmv citations, but never dismisses them. Fortunately, the cop didnt show up so it got thrown out!

    As for your job, these companies can fire you simply because an aggravated car driver called in on you. I think the fact that they arent citing the company could help, but a lot of companies are real strict when it comes to cell phone violations. I had a friend who got caught using his cell without a bluetooth. He told the officer that he was just answering a phone call from dispatch as he just left the yard. He should've shut his mouth, because at that point the officer checked the call log and drove back to his companies yard to punish the dispatch, he was fired after his shift lol.

    I wish I could say everything will be fine, but thats a tough situation your in.

    The last ticket I got (88 in a 70 in a Nissan Pathfinder) got reduced to a parking ticket. I was all in for 600 bucks I think. As soon as I walked in the door after getting the tick I called a local Atty. I was stressed and said, "you tell that judge I will come paint fences or pick up garbage or anything...I don't want that on my license". He handled every single detail perfectly. I hope you have already done it!

    However back in realville there are 2 issues. There is NO way this driver can not inform his company of this because at some point he must turn the inspection form into them. At best this driver has a visit coming to safety. If this cell phone use violation is noted on the inspection form it is going to most likely remain for many years regardless of what happens in court. So what the driver has to do is figure out how they want tp procede then do it. 4 points in realville are not going to cause many issues with employment. The carriers are screaming for drivers as it is. My main concern is I am hoping he can keep his job, the other stuff is commentary.

    I much prefer to come clean asap and let the company know, it’s better than dealing with the stress! Get an attorney and fight this as much as possible.

    At least it says right on the ticket you claimed to be changing music. That leaves a way to explain it which doesn’t seem so flagrant. You weren’t texting.

    Even though I have a phone mount the officer claims that in WISCONSIN you cant handle a phone at all

    Get a lawyer and go to court. I would go to my cell phone provider and get my daily phone log. This will show if you were talking or texting by the time on the daily log on your phone. You must know what time you were pulled over. You really need to go to court. This is your career, your life, your job. GOOD LUCK.
