Looks like it might be just more misinformation from my horrible trucking school.
That #### diploma is not worth the paper its printed on

 

It's easy to read .04 while operating a CMV and take away it means all vehicles. Also, I might add that generally speaking when the FMCSA refers to CMVs they also are talking about any vehicle over 10,001 NOT just CDL vehicles.

 

From what I gather it’s .04 WHILE OPERATING A CMV.

 

In the 70s and early 80s growing up in Fargo drunk driving was encouraged lol.

 

There was something in @Crude Truckin' last post that is something that does not get enough attention. So much of this is officers' judgment. I remember watching a youtube video not long ago of a police officer that made a case even though the person blew .00. He suspected he was otherwise impaired. I do think later a Judge tossed the case. Another thing to be watchful for is speed limits. My baby sister got a speeding ticket back when she was in her 20s for going faster than conditions allowed, again up to the officer. This is why sometimes I tell people all the time to read those small letters at the bottom of a state code. Even the FMCSA rules have exceptions to exceptions. This is one reason I never argued with a cop.

I paid attention to road signs denoting speed limit DECREASING and RAISING.

You go into a CONSTRUCTION ZONE at 20+ OVER in a commercial vehicle, You're resting for a while.

Why is it when people request advice for misadventures, they get all wobbly when advice submitted??

 

Hire a lawyer in the county where you got the ticket , it won't be cheap but they will know what palms grease.
Don't ask me how I know this .
