Hell if I have to give up a day or two work it is cheaper to pay.

A driver is responsible to know the laws of all states he travels in. Pay the fine move on.

sorry, no. i deal with china town and southie.

at one time, my company took southie away from me, thank god almighty, i was free at least...

then they gave it back to me, as the customer griped about them sending in thier own class B trucks...!!!!!!

what does that say for where i go in southie..??

so i been raising all sorts of heck with my company. they have had "new drivers" try to take over my run, but one night with me, and they quit the next night. company sent another driver with a new hire, he quit the next night as well..(at my china town drop, i have to climb a traffic island at the southies drop i have to go in the "back way" climb the sidewalk at an intersection, then ride a sidewalk for a few feet, then squeeze between parked cars on both sides, and that's when there is NO snow..when there is snow, i pray all cars are parked CLOSER to the curbing)...if i go in the "front way to southie,. my 53 footer will not bend, no matter how much i tried, to get around a telephone pole and a fire hydrant.

once there, new potential new driver, calls it a night and says he don't want the job...lol
and they DO QUIT when we get back in the morning...I DON'T KNOW WHY......LOL

my company has been holding a stance with the customer regarding THEY SEND in thier class B trucks, instead of a 53 footer.

i was told the customer is giving in to me not going to southie, i was told by hook or crook, i'm outta southie by mid April. then the customer has to deal with that drop.

then all i got is chinatown to deal with. and that traffic island I MUST climb up onto.....

You are correct in a general way, but INCORRECT in your specifics.Judges are ALWAYS going to be inclined to believe a cops story UNLESS (and this unless is a VERY VERY critical word) there is clear reasons for that Judge to believe otherwise. This while it does happen is NOT standard court procedure. As to the mistake in the ticket unless there is a clear state law saying otherwise it is up to the judge if the case goes forward. Also it is important to remember that ticket is only a summons. The DA can get the officer to amend form and manner mistakes because I actually have seen this happen. A mistake on a weight rating has no bearing on the charge unless it changes something about the charge. THIS topic right here is why I plead with drivers to go seek out the advice of a licensed member of the state bar not some truck stop attorney spewing myths.

I agree that he should seek licensed help.
But NO, the Judge does NOT always side with the cops. Just as often they know that the cop is adding to the list to pad the bill so to speak. Hoping that the driver WON'T fight the ticket.

Pretty much every state is different, IIRC.

Kind of why if your running 48 you need a current motor carrier atlas. Front section keeps you up on the different bus in states.

Somebody several months ago posted a fairly current and easy to read map of where the problem states were and their limitations (regarding trailer tandem settings)

I got out of a speeding ticket in MD just because the cop didn't identify me standing at the defense table! And the judge was highly upset with the cop for making such a simple mistake in procedure!! I always go to court! I take a personal day and get paid to go listen to all the nonsense in court! Very entertaining!!

I scheduled my court dates 2 days a month and always showed if I wasn’t sick etc. All my cases would be continued to my next court day. I usually had 200 cases give or take a few.

So yes State Officers rarely miss court but if they do they would be continued.

You are focusing on the wrong thing. Quite frequently irreverent data is ignored. The ticket wasn't for overweight, it was for overhang.
There is simply a box on the form for registered weight, the officer put in bad info. As it does not affect the citation it's unlikely the judge will toss out the ticket for that.

That being said, still mention it as the judge just might....
