Or worse yet to see someone get into a fight with their safety department or an examiner trying to use a law that doesn't protect them.
It has nothing to do with trying to make people a second class citizen or that they get a CDL and all their rights are gone.
Like drug testing, many will lead a driver to believe that they don't have to watch the girl/guy fill out the paper work or seal the bag, but it is their right to ensure that the chain of custody is followed. Too many of these MAs/want-a-be nurses are too dumb to learn the real regulations and law so they do what they are told and think they know everything over a patient. I've had this happen to me a couple times and I told them the same thing I tell all of you here, stand there and watch them and if they don't like it, call your safety department to tell them they didn't do it right.
The same goes for privacy rights, you don't have real privacy rights as many believe you do, mainly because we work under federal regulations and there is a reason why we are exempt. There has been no court case, no one ever charged and will never be when it comes to federally regulated occupations like our under any law. Disclosure to examiners, regulators, investigators and others who need to know or work in safety departments are allowed.
This does not mean that anyone can get a hold of your physical but rather it means you have no control over what they ask for and no way to refuse access. People are led to believe that HIPAA is one such law that allows protection but it is in the law that federally regulated occupations are exempt because it would cause serious problems with the entire system that the USDOT and other departments mandated under the laws passed by congress. The Same goes for Obama care where they are forcing universal medical records to happen with government controls overseeing all of it and those records can be used to adjudicate insurance claims in the future if one takes a government subsidized insurance.
As I also said, HIPAA only covers people who are in the medical field, it is there to protect inept people from being too open about one's medical condition as an example you go to any doctor's office or hospital who has a sign in sheet with names on it, that right there is a violation under the intent of the law. Talking about a case with people outside of the case itself can be construed as a violation too. I could go on for a while about it. Went and redone my DOT card a few ago, little lady ask me how much you weigh? I said 242, she ask how tall are you? I replied always been told I'm 6'-2" ma'am. She looked at her chart and said your Obese...... What?!
Then she ask do you snore? I replied my wife says only when I'm tired, LOL.... She looked up at me over her glasses and said "the answer is NO"!! Now do you snore? No ma'am. Lol. Do you have trouble sleeping Sir? Not really ma'am only... Then came that same look she gave me before! No ma'am I sure don't I said!!! Then she explained that if the answers were yes, She would have to get me a mask. Sure glad she was easy to get along with!

The best answer is always a simple yes or no, with no 'jokes' inserted.
Some of them are only looking for any small reason to get us on that machine.

You like to talk, so do a lot of people.
But you have to be smart, not conversant, at a DOT physical.
And since when haven't doctors been vultures?
Sure, there are a few that just want to help people with no strings.
But most have always been in it for the money, especially once the money got to be very good.
There has always been a new snake oil or elixir to sell someone. Now it is new 'miracle' prescription meds or procedures, which always make the doc a lot more money.
