Has anyone ever been hit by Martin Transptation systems(mts)

    Martin Transportation Systems of Grand Rapids Mi hit one of my trucks at a GM plant. The drivers took pictures, and exchanged insurance info MTS has accepted blame and has told me that the check has been requested but over 6 weeks later. You guessed it no check has been cut! My question is: If your a trucking company who has quite a few trucks and you say you are responsible for something (which is another mans livelihood) why would you intentionally screw him? any comments would be welcome on how to deal with these jokers, i have hired an attorney.

    Well, as long as you collected insurance information, photos, and witness statements, you should be in for a battle you can win. the truth is, from what I'm getting, Their insurance is waiting for a call from your insurance. Not likely their insurance co. will initiate the coordination. It's gonna be up to you/your attorney to beat the ground. Just imagine what THEY would do if YOU hit THEIR truck. And, do that.

    I think they must b self insured I called their insurance company and left a voice mail Five min later I got a called from the Safety dept. I could file this on my insurance and pay my deductible and wait on my insurance to collect and then get my money back, but then have a claim on my insurance and watch my premium go up due to their neglect. This is just very frustrating to think that they have let a little $2000 claim, turn into a $7500 lawsuit!

    They aren't big enough to be self insured.

    So how big do you need to be in order to be self insured? I know they have way more trucks on the road than we do, and we are self insured.

    The way i understood the FMCSR was....you have to have a lotttttttttt of money to do it....

    Call YOUR insurance agent and let them deal with collecting for you. Since its not your fault there shouldnt be a hit against your insurance for filing the claim. You pay enough to the insurance Co let them do the work you pay them for.

    well i have found out with a little research that Martin transportation systems is going broke and does not have cash flow to pay this claim, they will not turn it in to their insurance co because the insurance will bill it back to them they are insured but any claim up to a certain dollar amount (probably 10,000.00) they pay on their own.
    the lawsuit has been filed and it will probably go over the certain dollar amount then they can file it with the insurance co O/o beware of Martin Transportation systems they will wreck you and not take care of it!!
