Has WalMart sunk to a new low?

    That isn't what Walmart said, though it is reasonable to assume it was intended to be interpreted as such. They said they would take responsibility if their truck was found to be at fault.

    I believe NJ is a "contributory negligence" state, so any negligence on the parts of the injured parties that may have caused or contributed to their injuries is relevant.

    IIRC, this wasn't a "limousine" with an open floor/bar/phone, etc., but a passenger van.

    Thatd be the same as hitting a school bus and blaming the kids for not buckling up.

    Too many if's in this case. IF Kim Kardashian had been riding with him, he wouldn't have been injured due to her being a humongous air bag.

    A lot of blah,blah,blah so far,but to answer your question (has wal-mart sunk to a new low) oh heck no..This company has been low balling & putting small mom & pops out of business since day one.They low ball employees on a daily bases.They are cut throat to the core.You cant sink to a new low when your on the bottom sucking the sap out of society..

    Comparing a bunch of people drinking and partying in a limo to school children is a bit silly don't you think? And in a court of law, whether right or wrong, it will be portrayed in this exact light when it comes to the driver's defense team and Walmart.

    And then there the construction company. Were the warning signs in the exact spot as required by New Jersey law? Were all the reflectors on the barrels clean and visible? Were all the warning lights working correctly? In this day and age, lawyers look at everyone vaguely connected to the incident.

    The thing that hurts WM in the court of public opinion was their initial statement (not cleared by their legal team, I'm guessing) about wanting to do the right thing. NOW they come out and try to put up a defense (no, I don't blame them either, as that's the way the game is played, like it or not). They should have just shut up about it, perhaps just offering condolences to the victims and leaving it there.

    They never did state exactly what doing "the right thing" actually meant though. Maybe doing the right thing is to fight the lawsuit to the very end. I know if I was sued the wrong thing to do would be plead 100% guilty and pay some ambulance chaser my entire life savings.

    True...vague at best...I still think they should have just STHU....but, I'm just a driver....and I didn't even stay at a Holiday Inn Express last night...:biggrin_25523:
