Have YOU been cited for a CARB violation?

    I agree with you!! I have heard the nightmares but have yet to see the enforcement. I see old trucks running around, none are blowing black smoke, but they are still old.

    Sorry if my brash no BS approach offends you but,

    Again...

    My point in starting this thread and keeping it alive is i am looking for ONE 1 ONE SINGLE truck driver / owner / shipper.... ANYONE.


    No BS I dont care about someone who knows a guy or heard bla bla bla...

    I WILL PAY MONEY ($100) TO YOU - YES YOU!!! If YOU can show me that YOU were cited, towed, shut down, etc... For a CARB violation..


    YOU CANT because they HAVE NO AUTHORITY to do it. Im just trying to stop the BS of truck drivers crying wolf. We have plenty of real problems, we dont need drivers making up an invisible boogyman for people to worry about.

    CARB can not and will not do anything about your old truck. Cities and ports can and do but a bunch of tree hugging hippies writing a bunch of rules that they would like to see become law someday does not worry me.

    I know FOR A FACT that your TRUCK was not cited for being a 1999 to 2005 engine. A reefer, maybe but not your truck. I live 1 mile from I-10 in Phoenix. So anyone on their way to CA just needs to let me know when they are on the west side of PHX and I will meet you at the freeway with a crisp 100 dollar bill.....

    THAT is how you stop the BS!

    Go ahead, somebody post a story about showing me your ticket and getting that $100....

    Not sure what your whole point is. Are you saying CARB doesn't issue citations? Or that they haven't issued citations for trucks? Or that they never will issue citations for trucks?

    If it is you think they are not real then you need to talk to the CA produce industry. This phantom agency has costs them dearly.

    First year of enforcement of TRU I had several people tell me they only issued warnings and that had people thinking that was the extent. Then they started issuing fines and including shippers.

    CARB knows where the line is and takes everything right to that line.

    There is a video on Youtube video of a green bear giving out $300 tickets at a truck stop for idling. I'll post it when I will get home. I won't be in Phoenix anytime soon so you can just cut a check and put it in an envelope. Thanks

    The issue for me is that they don't have the authority and if there is an issue with an out of state truck not being compliant with their requirements, they can't really do a thing about it. Some companies have been cited for CARB violations and because they have no court case against the issue, they are on the losing end of it because the case has to go through the federal system.

    What I have been told is this, California has no power to prevent a truck say from Kentucky from entering their state - zero zip not'a. The CARB requirements have to be applied to the home state where the truck is registered in order for any power by California. BUT that said, the engine tag issue of a few years back is within their power and has to be there under federal law.

    The background for this is the agreements they sign back in the 40's when the feds were trying to unify and harmonize the laws ans regulations and again reaffirmed it in the 60's when the federal highway system funding system was changed - essentially it comes down to the feds write the regulations and a state can only exceed those regulations on trucks for trucks within their state.

    On top of that, starting with a couple court cases in the 1800's on navigatable waters, the court has said federal government has an exclusive obligation to ensure fair trade across state lines. This includes tranportation of goods and access to markets. Having to have special equipement on roads that are federally funded by not just the road taxes collected in the state but also by the federal taxes collected throughout the country seems to fly in the face of the interstate commerce clause and the rights of the feds.

    Now this goes without saying but if the feds don't want to contest the overstepping of the states on this matter, and even if the EPA has reconginized CARB regulations (which is superceeded by the ICC in the constitution), then it is up to us 'the people' to get congress to act and possible have something go through the courts to force CARB to accept existing laws. I do not think that OOIDA, ATA or other organisations are yet willing to start fighting, even though the OOIDA should be actually preparing for it or willing to put up with demands of their members.
