Help. BOL has broker listed as "carrier"

    Some time ago I saw a law that prohibits broker's from being listed as the "carrier" on the BOL.

    Can someone tell me what that law is? Or more information about it.

    I have put a "/" behind broker name and wrote my company .
    I don't know what the law is.
    I do know my company has to be on the BOL to make it a legal document, so I get paid for the load.

    If in question, I’ll sign BOL with my name followed by date and my Co. Name and truck trailer#s. Proves I was given the Load.

    What’s really great is an example of the Load I’m currently on. BOL has different Broker listed as Carrier. Obviously dbl. brokered. Except now I know who has the account. Lol

    Broker can't hold themselves out as a carrier(unless both authorities are under the same MC#) Shipper can put any name they want, up to you to cross it out and insert the carrier name, if you want to be the carrier of record. No regs govern the shipper on that, just the broker.

    I have taken a few loads like that and every time I call in and ask them why is their name listed at the carrier. The usual response is "Thats just the way we have it set up".... Landstar is bad for that.. "Check in as a Landstar driver".... How bout NO!

    In a court challenge, if the BOL doesn't have the trucking company's name on the BOL, it could be very easy to say that the carrier has no claim at all to being paid for anything.

    The broker could very easily say a different trucking company or their own trucking company moved the shipment.

    Hasn't happened to me yet, but I thought I read somewhere that a law or a rule that prohibits the broker "acting as a carrier" misrepresentation

    The reg is they can't hold themselves out as a carrier. Shipper isn't subject to that. Just sign as carrier of record.
