Hi, we have been in business for about two years, i get the loads my dad drive the truck. We never had any problems until now. We booked a Houston to California load the beginning of this month, we factor the load and everything was ok. Two weeks ago i receive a call from the broker that he needed the bol and i told him that they only gave a packing list to my driver which is signed by the shipper and receiver and he told me he was going to get the bol from the shipper. Today i receive a call from our factoring company that they are going to do a charge back on the load because broker say customer wont pay if he dont receive bol. We dont have a bol as that was the only paper we got, broker wont answer.

Find out if the shipper or receiver hired the broker ( most likely the shipper but you never know ) and call them - ask if they hired Joe Blow broker, etc...and explain the situation. Ask if they can send over a signed BOL for the load and then send that to the broker. If that doesnt work then PM me and I will get a good resource for you to close out this situation.

I just talked to the broker and he said he send an email to the shipper but they have not respond, i told him that i want to call myself and he said he doesn't want me to do that and that he will email them again.

Sounds like you have a real problem . No sign BOL ? A packing list might not cut it if you delivered to a large CO.This could take a long time to get paid IF you get paid . You should have your own BOL with the one the shipper gives you and get both sign and printed name on it

Packing list should serve fine as a BOL man. Dont think most people get it but a BOL can be a handwritten piece of paper with "what's on the truck". I know ive done it at a moving company and twice hauling a dry van. Sounds to me like the broker is ripping you off. Why would he not want you to call the shipper after all...

Total BS he is trying to keep your money, POD is just what you have the customer can call the receiver and ask if X________ works there yes did you get the shipment yes. The broker will get paid for that load I'll put money on it
Call the shipper yourself don't really say what's going on until you find out if they received POD if they say yes ask for a copy when they fax that to you it's time to get on the phone with the broker. After 45 days if it makes it that far file on there bond. I even send a bill to the shipper at this time most the time I'll get a call saying WE HAVE PAID THIS and get that proof it's been paid. -

When it comes down to it you are the office guy for a guy who kills himself and risks his life to bring in the money. this office weasel is trying to rip that guy off, the guy who keeps you living in a house with food and sleeping in your own bed every night, for a few thousand dollars. Because he's a scumbag. You can step up be a man and fight (that's your job) or let the guy who depends on you as his lifeline get #######. Up to you

Btw any lawsuit would be Federal. Federal jury awards last i heard were mandated 3x damages (in order to keep people from doing the crap in the first place)..
