Hi folks,
So I am a new company with authority just over 90 days. My hubby..owner of the company just got an out of service due to hours of service.
What happens now? I want to kill him.
Will the FMCSA shut me down now since I am so new or will brokers not want to work with me once this shows up on safers?
I had 2 other driver inspections and 1 vehicle that were passed with flying colors.
The hubby is sitting in Iowa for 10 hours now because he made a stupid decision and I am in the office panicking. Will I for sure have a safety audit suprise within the next few days?
Any advice would be appreciated, what should I be doing now?
Thanks in advance guys...

Not for sure but think you'll be fine. The megas always have driver violations and haven't been shut down yet.

If it were me, I would go through your husband's logs with a fine tooth comb and document any errors. Then I would subject him to the disciplinary actions outlined in your safety policy. At the least, I'd want to note in his driver file that he attended a safety meeting & was retrained in logs.
Sounds silly since it is your husband/the owner, but it'll assuage any grief the dot might want to give.
The fmcsa won't shut you down for 1 HOS violation. Most brokers won't care, though some will (England logistics, for example, has a clause in their contract regarding HOS violations).paul_4lp Thanks this. -
If you've have had authority for 90 days, then you haven't had your "new entrant" safety audit yet. This could move it up, but I doubt it. Chalk it up as learning and keep going forward. As double yellow said, document it in the proper places and make sure everything is up to snuff. All part of the game. when they do call and make the appointment for the audit they will most likely ask about it. Just be ready to show them how it made you better, and things will be fine.

Hmm some companies give a driver xx up to 90 days to complete a mandatory log course or they are placed on safety hold.

You have to have five inspections before it ever starts showing up don't loose sleep over it.

When your husband comes through, have him go thru his logs and correct any mistakes. Make sure time stamps match, also 30/10/11/14/70/34 all have to be in compliance. If necessary send your logs out get a pro to review them.
As far as mad at your husband, dont even go there. If your not a driver you dont even have that right. Be cool.25(2)+2 and RedForeman Thank this. -
You are dead wrong powder joints. It's here company and she has every rite to be mad,it's her company to and things like log book violations affects the company as a whole. Get just a few more here and there and it can turn into trouble real fast,so go ahead and chew his as Mara and like every one said go through the steps to make it right. And as far as the Mega companies most off them are on E-Logs.

Sounds like the driver in question will have to watch safety videos when he gets back home, it happens to alot of drivers he just got it out of the way early in the 1st 90 days?
