Help Needed Selling Truck and Trailer please

Well then I need to ask you all my questions because you are the type of help I like....thanks so much for you expertise both as a truck driver and a tax preparer.

Look at it this way;
As a sole proprietor there is no difference between you and the business. You ARE the business. The business IS you.
You are free to deposit and withdraw money from your business as you choose to and see fit.
As far as who the buyer makes the check out to ...... it doesn't matter as long as he gets a clear clean signed title to the vehicle.
The buyer can make payment to you OR to your business. Once he has a signed title the DMV does not care who he made the check out to.
Your bank probably does not care who the check is made out to either - as long as that person is listed as an account holder.
The IRS doesn't care who the check is made out to as long as the money is treated correctly at tax time.
Your mechanic is not going to care who pays him for the work - as long as he gets paid.
As a sole proprietor, the money is all yours. DBA doesn't matter because you are not a corporation the business is not seperate from you.
If you're in business, you should know this.

Okay I am no longer driving for myself. I have the truck up for sale and although I am not driving it, my authority,IFTA and insurance are all still active. I figure they better be because its still under my name. i am needing to sell the truck to pay off business debts,so the business is still active I guess. I cant figure out in what order to do the following things..suspend authority,cancel insurance(they say they need 30 days notice),stop IFTA filing,sell truck. Should I cancel my authority before the truck is sold,or after? If I cancel it first then I wont be able to let some one test drive it to buy it. And If I dont cancel it before I sell the truck,can I let someone behind the wheel to test drive it as they are not an employee???
I have never sold a commercial vehicle before. Can I let them test drive it? Does the purchaser have to have a valid CDLA? Do they have to be over 21? Do I have to require them to get it insured before they drive off with it? Should I make them sign a contract and where can I get one?Last edited by a moderator: Jul 15, 2010

You are not in business anymore. Why pay for this stuff? I told you when to cancel the IFTA. You are not planning to restart the business are you?
You do not need authority or ifta for someone to test drive the truck. Unless of course, you are going to let them get a load and head to deliver it in another state. -
If they test drive the truck it has to have insurance on it though,right? When do I cancel insurance? Im not trying to be apain,but I hav spent hours upon hours for the last couple weeks just trying to get ahold of the authorities inmy state and federal and all I get is voice mails and no answered calls.

You no longer need commercial insurance. Just bobtail.
When I cancelled my authority, it took only 1 call.
