Hello everyone! I am in a bit of a sticky position. I am presently trying to apply for a new job. I have been unemployed for 6 months and have been applying at many truck driving companies. I recieved a speeding ticket on 8/14/12 doing 80 in a 65 in my personal vehicle. My court date is this coming Monday 09/17/2012. I have a clean record except for this violation. I can not afford a lawyer $350 is the best fee's I have found so far to get this ticket off my record. I have not reported this to any comany I have applied to as it does not show on my MVR yet. The question is do I pay the fine and have it go on my record as one 15+ speeder or go to court on Monday without a lawyer and hope the judge will help me out. Or do I pay the ticket and have it put on my record after the companies have run an MVR and don't see it? I need to take action tomorrow on this if I want to pay the fine and plead guilty. I figured Experienced truckers advice would be the best place to post this in. Thanks in advance! I hope someone has a good answer!

Tell the judge the issue. Ask for driving school or supervision. Ive gotten out of faster tickets. But eith a lawer. Good luck

You need to find enough money to hire a good attorney>your driving career depends on it. NO company worth a pinch of coon #### will hire you with a conviction like that regardless what you were driving.

Beg borrow but dont steal the money for a lawayer that is your best bet always get a lawyer.Ask someone for the money when you get your job thats the first person you pay.

On a side note, I don't know what it is with all these guys wanting to get a lawyer involved with every little hiccup out on the road. IMOA this garbage just adds fuel to the fire. If this country would get rid of all the lawyers and insurance companies we wouldn't be in debt, you would actually HAVE a paycheck and people would man up and do what's right instead of calling a 800 number for everything from a flat tire to a minor fender bender.A21CAV Thanks this. -
If you already have your CDL then Drivier School is out. Best to just go to court and try to get the Prosecuter to lower it to at least less than 10 over. And be prepared to pay what ever the fine would be for 15 over.

80 in a 65 is normal. looks like you just got the #### end of the stick that day. I got a speeding ticket in 06 in conneticut for 76 in a 55 on i95 had to pay like around 700 bucks but it was completely removed. if nething try to get it down ti 5 over. companies usually post on there requirments no speedings 15 and over. you are human

When you go to court you will likely be talking to the state's attorney first, NOT the judge. The state's attorney is the one prosecuting you (NOT on your side). Some people don't seem to understand that. However, they are often open to negotiation. The main thing is if you talk to the state's attorney without a lawyer, DO NOT admit guilt.
I would look him/her straight in the eye and say, "I am a truckdriver, I can't afford a moving violation. Can you ammend this to a loud muffler ticket with court supervision ?" Many of them will, the court gets paid, they get a conviction, everybody's happy.
However, you will run into some who will not bargain, especially if you have something on your record. Do NOT tell them you can't afford a lawyer. If the state's attorney refuses to ammend the ticket to a non-moving violation, tell him you want to call your boss to see if he thinks you should get a lawyer. I've done this twice. Both times the states attorney let me go make a phone call, but then I had to go to the back of the line and wait for everyone elses case to be handled. However, when it was my turn again, the state's attorney is tired, nobody is left in the room except for you, him, and the judge. In my experience this is where it's easy for them to cut you a deal. Do you understand what I'm saying ? I mean there's no witnesses there to go blabbing about how they let this truck driver off for a loud exhaust fine. Now if he absolutely still will not cave in, you can either say ,"I want to hire a lawyer then" in which case they will give you a continuance, give you another court date and you come back with a lawyer. Or, you could at this point beg him, "Well, at least ammend the ticket to 5mph over instead of 15".
It just depends on the court, I've had them change it to loud muffler without me even asking for it, just because I was a trucker. And I've had them treat me like I had ran over a schoolbus full of kids just because I was moving on an orange light. good luck !Jbkrash, Rogerthat, Keyster and 1 other person Thank this. -
