DFW, TX: Hey guys. I need some serious advice. Basically, I’m struggling to get a job currently because of a “company violation” which was a failed hair follicle.
I stopped all smoking almost 1 year ago and my hair follicle was clean at my first job (the test results only went 90 days back) - I lost this job due to overstaffing.
At this second company, I did the urine and hair follicle test. The urine passed, but the hair follicle tested positive for THC and the company told me that this test goes back 2 years! Ive heard you have 72 hours to “dispute” the drug test, but it is past the 72 hours. The only other option I was given was to write a letter trying to dispute the “violation”
Anyway, this was a pre-employment test and I was only in orientation but the company put it on my DAC as a company violation and not a failed test. I’ve applied at 2 other megas, and they are saying that they can’t take me due to this. Was supposed to have orientation with USX and they said that I’m “unqualified” due to the “company violation”
As I stated, I stopped smoking almost a year ago. (Stopped January 2025) and the 90-Day follicle test at my first job was clean. But this 2-Year test was not. I’ve only had my CDL for about 4-5 months now and am not sure what to do from here. Any advice is appreciated!
*** nothing is in my clearinghouse. It’s clean. These mega companies are apparently seeing this on my DAC report.

You( or we) are being had, my friend. I never heard of a hair test going back 2 years. Everything I've researched online say it goes back 12 month MAXIMUM,,,so something doesn't add up. Don't be upset, I'm on your side, and if I were you, I'd say, up yers to the industry, ( wait, I did do that) get a managers job at Walmart, and above all, in your private life, DO WHAT YOU WANT TO DO. Obviously you like to smoke, and attitudes are changing about that, just not in the trucking industry, and never will. And just as well, it's no place for weed, but that "red flag" will dog your driving career until the lights go out, so I wouldn't even bother. By "disputing", it means you are willing to go through the SAP program, you have little, if any recourse.
I want to make clear, your life isn't over because of this stupid test. We are currently in a dire situation for workers, and many places would hire you in a minute, based on your current situation, not something from a year ago that has no bearing on present performance. I'm telling you, one of the downsides of this age, is something like your hair test goes on record, may as well be at the Pentagon, it's forever. Good luck. -
As I told you in the other thread, it depends on how it was reported. If a company puts in your DAC as "failed drug test," no reputable trucking company is going to hire you for minimum of 3 years. If a company does a background and sees wording of a drug and alcohol event of any kind, and that would be failed or refused drug test, DUI, DWI, caught with a beer in your truck, perhaps even public intoxication, companies will pass you over.
However, if they look at your background and see wording of "violation of company policy," then they can hire you. This explanation was from the recruiters at my current company, and they offer no fluff either. Straight up honesty. If your record is trash, they won't hesitate to deny you. You ain't coming to orientation til you clear all the hurdles. We've people get hired that had events but the wording didn't suggest a drug and alcohol event. Some of them are still here right now, and others have moved on to other companies. The better companies won't ask for details.
I think the fact that you left your 1st job so soon is hurting you as well. What does it say on your DAC? Are you giving them details about your drug test?
