also the fair labor standards state, The FLSA does not require any specific payment system, so employers may base pay on time at work, piece rates, or some other measurement. In all cases, however, an employees pay divided by the hours worked during the pay period must equal or exceed the minimum wage.
Th Equal Pay Act allows disparate payments to men and women if they are based on: seniority systems
merit systems
systems measuring earnings by quantity or quality of production, such as a piece goods arrangement, or
any factor other than sexfor example, salary differentials that stem from unequal starting salaries based on differences in experience levels. -
Not saying that this is the case, but might come to that based on the state laws. -
At many companies that's how it is,the new person gets the best loads. Most companies don't go by senority. In my case if you wanna read back to my posts,im not at all talking about making the same amount as they are.Of course they deserve more pay.Thats not my beef.My beef is pay me hourly like those other drivers so we're all on the same page.I'll settle for less per hr.Its really sad knowing what im making per round.I try not to think about it because it upsets me.When I get to the Akron terminal I will be talking to Mr Heyl about this.

roadmedic,
As a former bookkeeper, you know the person that actually does the work the accountant oversees, it makes the accounting process easier to pay everyone the same way. But I had the joy of paying people doing the same type of work, as a flat rate, hourly rate, commission, and a mixed hourly/commission... made the bookkeeping a little more difficult, but never had anyone say that companies must pay all employees the same way for the same work, even on federally funded construction... we just had to show they were making at least the mandated minimum. -
I was referring to two people doing the exact same job and duties being paid by different methods.Last edited: Apr 24, 2014
